Can a State Farm claim be filed against a place of employment, when a theft occurs in paid parking garage?

My job offers parking in a garage that some how supposedly has security for a monthly charge to its employees. However there have several break in to vehicels and now it has occured to me.Letters have been sent to the head honchos about the cocerns for the saftey of employees and their property.Security gaurd superviser apologized to me but had not much else to say but that there was really no SAFE place to park anywhere!! I have State Farm insurance. I now will have to pay a deductalbe for a broken window. Is there any thing such as fileing a claim against the employer?

If anything, wouldn't the claim be against the security company? Ask your insurance company to go through subrogation. If they think someone else is liable, they will want to be reimbursed by the liable party. Let them handle it. That's what GEICO did for me. After they filed arbitration against the other insurance company, we won. GEICO got reimbursed from the other insurance company. GEICO then sent a check to me.

First of all, it may be cheaper out of pocket to have the window replaced.
Secondly, why would you want to sue a company that offer free parking in a garage where you work? I mean nothing is 100% safe.......People will find a way to break into a car no matter where it is parked. That is not your companys fault!

There is absolutely no way the parking garage or your work is paying for the damages. They are not legally responsible and you shouldnt expect them to be.

So your telling me that when a lot has security that you think legally they are responsible for anything that happens? thats ridiculous. Just b/c a lot has security DOES NOT mean that it can stop all bad things from happening. They arent god. They certainly help MINIMIZE things happening to cars- but they cant prevent it.

So.. the short answer is no. you arent getting your money back.. absolutely positively no way. anyone who says otherwise in misinformed on car insurance and laws. Open your eyes and see this from a point of view other then your own.

No you cannot file a State Farm claim against your place of employment. State Farm will only cover the cost for damages under your comprehensive coverage, if you have it. If you like your job, I wouldn't suggest that you file a legal claim against your employer.

It depends. Most likely, the parking garage is not liable for personal possessions or damage while parked in their facility.

Look around the parking lot. Are there signs saying something like "park at your own risk" or "not responsible"? If so, you're out of luck. If not, you still might be out of luck if the security company took "reasonable efforts" to maintain security and the break ins were beyond those efforts. At any rate, your problem would be with the security company for failure to provide a safe environment, not against your employer.

STATE FARM will replace the broken window, and THEY will go after the owner of the lot if they feel they can get a claim from them.

But this is a Comp claim, so maybe, maybe not. Comp claims also do not reflect on your insurance rate!

Too bad you have a deductible. I have a $0 deductible on my Comp (State Farm) because I am too broke to shell out $100 for any incident. Look into it. It`s only a couple dollars more a month.

Yes the parking garage is being paid to provide security for your vehicle.

I would think so! You pay for security and it wasn't secure so they should be liable for the breakage of the window. ask your insurance company what they feel they should know!!!
