My Brother is 16 years old, and has his drivers license but is not on either my fathers insurance nor my mothers. Can he drive with out a parent? He should have been added to the insurance policy when he started driving with his permit.

no , if you get into a car accident your parents will be held liable and not the insurance company.If you got into a car accident you would also make it possible for the other driver to sue your parents in civil court. |

Prob. not. Although he may be covered automatically by that insurance without your parents adding him.
BUT... if he is not, the risk is tremendous. If he causes a major accident he will lose his license but his parents must foot all the bills.
With the cost of a typical vehicle in the $20k range
Most hospital stays a minimum of $20 to $50k for a broken bone or two
and Pain and Suffering and expenses in the $10 to $20k range for a disabling injury like broken bones but nothing permanent. For permanent disability - think 'sell the house'.
your brother needs to ask, in his most mature manner, can your parents afford his mistake or should someone buy the insurance (or he simply wait to drive) .

If your brother has an accident, the owner of the car will get sued as well as the custodial parent.
(At least that is how I would do it if he ran into me).
Make sure the custodial parent knows that he is driving since they are being exposed to the liability but are not even aware of it (thats called blindsiding)

I believe most states require insurance on the car not the driver. thats how it works here in NY. As long as the car has insurance it's covered no matter who is driving assuming they have a legal drivers liscense. |

No absolutely not....unless on private property...but will not be covered if anything happens. Your parents will be held liable if he drives on public roads and is in an accident and it could bankrupt them. If he is pulled over he will most likely get a very expensive fine....license taken away for years and go to court with lawyers fees .......it may be a wise decision to inform your brother....and if he persists then let your parents know. Your brother is doing a very foolish thing, but may be ignorant to the consequences or the law. Give him a chance to do the right thing, by informing him, and if he continues...let your parents know. If your parents already know, than they are playing with fire. I'm not sure about other provinces but in Ontario, he must drive with a licensed driver who has had a license for 4 years. If he is 16 then he will have his G1...it takes a year to get G2.. and then the restrictions are less. Best Google and check the government Ministry of Transportation website and search G1 license restrictions or FAQ which is frequently asked questions.

He's not legally allowed to drive at all in most states. But there are hundreds of thousands of uninsured drivers out there. It's hard to enforce. Unless you get pulled over, there's no way anyone will know you aren't insured. |

No one is supposed to drive uninsured. Maybe he would be covered as a "permissive user". Read your parents' insurance policy to find out. |

That depends on your state. I live in Alabama, and if you drive without insurance, you can be fined or arrested, depending on the situation. If your state does not require insurance, then yes, he can drive without it as long as he has his license. |
