ok i divorced my husband we had an expidition under both of our names after we divorce he kept the car he had the car reposes we was sent to court so they can get their money since it was a 3 year lease now the finance company is garnishing my wages since he was hiding from them. so they went after me so is there anything i can do so i can get aleast half of the money they are garnishing from my paycheck since he did keep the car

Unfortunately, they were able to find you because you are the one not hiding and taking responsibility for things. You both signed, they found you.
Yes, you can sue him for half, or even all of it since he has the car, but it will cost you even more to do so, and he will probably hide from that obligation too. I'm sure the car company looked long and hard for him before bothering you.
So, yes, you can, and you will probably get a judgment against him (I doubt he will bother to show up and you'll get it by default), but collecting will be a whole other thing. |

If the car was awarded to him in the divorce settlement you have no liablility for it. All that is needed is to contact the bank/lein holder and fax over a copy of your court records showing the vehicle was awarded to him and the should stop the garnishment and even refund what they already took.
If for some reason you still had joint ownership of the vehicle or you never took your name off the paperwork then you can sue but he probably won't pay based on his history. |
