Can i sue the guy that hit my car?

Two days ago i was at work and my babysitter called beacuse my daughter had an allergic reaction to cookies and the doctor told me to bring her to the hospital right away. Well i work with my sister and i driver her to work every day so she had to leave with me. I made her drop me off at the hospital ith my daughter that way she could go get her daughter and meet me back there. (I thought myy daughter being at the hospital was more important) Well she is two block from the hospital and called me to tell me that she was in a car accident. She told me me she was at a stop light and someone was in front of her. Well a pensky moving truck slamed into the back of my car, broke the windshield and smashed the back all in and cause her to hit the person inf ront of her causing alot of damage in the front car also.Now i have no car to drive and thank god no one was hurt. on top of which the car was being sold today and so i am out a car. what should i do? I know my sister and the 5 month old baby went to the hospital to get checked out and i think she sprained her neck or something.

Way too much information. But, someone was driving your car with permission, therefore they were covered. Since a truck hit the rear of your car, their insurance will pay your losses. If your car is not drivable, look into getting a rental until the insurance settles with you.

Since your car was a branded title, salvage, you can look to getting around 50% of fair market value from the other company. That is why most people won't buy salvage titled vehicles, and why insurance won't give you full coverage on one if you do.

Any injuries as a direct result of the accident will be covered under your medical coverage.

Well the truck driver should have insurance that should take care of your family and your vehicle. It may even cover the damage your vehicle did to the vehicle in front of yours. You do need to contact your insurance and they should take care of most of the info back and forth up to the settlement offer. If either the truck driver or you don't have insurance..... that is when lawsuits may come in and fines, etc. Be glad if your family is okay and your car is replaced or paid for. Lawyers get like 30% of any settlement you would get, so you possibly will be better off to settle out of court. You may want to spend a little to speak to a lawyer just for advice prior to any settlement.

Why do you feel the need to sue? I'm sure the moving truck had insurance on it -- besides, once you get lawyers involved it will only mean you LOSE 1/3 of the money to them!

The driver of the Pensky truck is responsible for all damages in that 3 vehicle crash, including any and all medical expenses. You probably could sue, but that's about all you're going to get out of it. Call the Pensky truck rental and explain that you are without transportation and that they need to provide you with a rental, until such time as they are ready to make a settlement. BTW, you may have to hire an attorney, to get anything done. You should have contacted your insurance agency immediately following the accident.
