No. You're not responsible until a judge says you are - and I've NEVER seen a homeowner held responsible for damage to a car parked in their lot. Except if YOU threw a baseball through the window.

What is the condition of the tree? Is it alive or dead/dying?

The easy thing to do is contact your homeowners insurance and let them know about the incident. They will do an investigation. If they determine you are liable - they will settle with the car owner. If the tree was a danger, and you were aware of it, and did nothing to solve the problem, you are responsible. If not, it was an act of god. If the car owner has collision insurance on the car it will cover it.

Bottom line, if you weren't negligent, you have nothing to worry about.

If you let them park there, then your home owners policy should cover it, if you have one. If they parked there without your permission its there problem.

Were they parked there with your permission? If you invited them, then probably yes. If the just parked there with no permission or invite then prob not.

we just had something similar happen - our insurance said that it was an act of god so we were not responsible. Is that parking space assigned to you (like in a condo or townhouse neighborhood) if so then the person shouldnt have been there in the first place

i dont know the laws that exist in your state, but i would contact the police and have them take a look at the damages. the local authorities will know what to do. it is always a good idea, whenever you get in an accident, to call the police so they can be a reliable witness to whatever happened. :D

The Good news is: your homeowners insurance is designed exactly for these sorts of things. So they will pay.

The Bad News is: if you dont have homeowners insurance you will have to pay unless the owner of the car doesnt come after you.

P.S. you should look into if the owner of the car intentionally made the tree fall on his car so that you would be liable. There are many scams like that going around these days.
