So today I had a man buy my car. He wrote me a check and I signed over the title to him. Everybody appears happy! 20 minutes after I sell it to him I get a call from him saying that he just realized that the back hatch doesn't open and that he wants to "renegotiate" the price. I told him that he ALREADY BOUGHT THE CAR, and that he can't renegotiate this deal with me. He said he might want to give the car back to me, and call off the whole thing just because the hatch wont open. I thought that sounded fine, as long as we can legally sign the title back over to me without messing it up. Because he hasn't registered the car in his name though, I feel like it's not possible to do this. Would I need to get a new title? Is this guy insane? I'm tempted to just tell him "too bad, you've already bought the car!" but I feel bad since this hatch thing is really important to him. Ugh!

To do it the way Vicki G is suggesting would require you and him to lie to the DMV. I would not open myself to that risk Besides, She is talking about California laws and forms. You haven't told us which state you are in. In my state what she is suggesting can't be done.
He cannot simply give you back the title. If you allowed that you would have to get a new title since titles cannot be "whited out" or changed or altered. To do it the right way and legally, he would have to get a new title in his name (he would have to pay sales tax and all of the associated fees and then you would have to "buy" the car from him. You would then have to pay sales tax and all of the associated fees to get a new title, Etc. I wouldn't take the car back. Way too much hassle for both of you. A deal is a deal. |

My guess (which is just that, though it's sort of based on personal experiences) is that he'll have to get a new title with HIS name on it, and sign it over to you. |

Yes he can give you back the title. When you go to sell it again you will include a form REG 101 Statement of Error where you and new buyer sign. And Statement of Facts REG 256 to explain reason and what happened. Also REG 262 to state the odometer reading. These three forms take the place of the title (you still need to turn in the title though)

Don't forget to get the car smogged.
It's best when both buyer and seller go into the AAA Auto Club together so you get all the signatures in the right places. Only one of you need be a member.

Tell him to bad, but if you must do something for your ego, negociate some of the money he paid for the car for his dislike in the car, to be put forward to fixing the hatch |
