Can you file against two insurance companies for one car accident?

My boyfriend's car was hit by a co worker. The guy's insurance company gave my boyfriend a check for the damages and he spent it on something else. Now he has decided he actually wants his car fixed and is thinking of filing with his own insurance company for the SAME ACCIDENT. I told him I was pretty sure he couldn't do that but he swears he can. Who is right?

No it is a form of fraud Insurance is to put the one who has lost something back into the position as far as possible that he was in before the loss. You do not and legally can not profit. What would happen is that if the two claims were innocent the two insurance companies would pay out in proportion depending upon the policies.
If it is deliberate you can find yourself in front of the beak and you may find it difficult to get insurance in the futur.
If he tries it and gets caught I hope they throw the book at him

No, he cannot do that. That is considered fraud. If he turns it in to the insurance company, they will investigate, contact the other party ( or their insurance company ) and find out that he was already paid for the damages.
