Can you renew auto ins. in a dead persons name and it be legal?

My mom passed and my sister got her car. she can't get the title changed to her name. but has renewed the ins. in Moms name as well as the tags. Is the Ins. and tags legal? Or if involved in an accident is she the same as uncovered. Could this even be Ins. fraud? I hope someone can help before she ends up in a world of mess! I learned all this tonight and can't contact anyone local until Monday.

There was no will! The sister over the estate has messed over the other three and has kept titles refusing to let them go. The sister driving the car refuses to believe me when I tell her what she is doing is not legal! I wanted to make sure and hope she will also read your words and put faith in them!! Your sister is illegally driving the car and will be held liable if she has an accident. Why can't she get the car in her name? One must have a car in her name before she can legally insure it. Surely the person who's supposed to take care of your mom's will can get it legally done so you sister can be safe and legal. She needs to park it before she has an accident and thinks she's insured. Call her insurance agent immediately and tell him/her the facts.

No, because if you had an accident or filed a claim, since the insured is deceased, the claim would be denied by the insurance company......it's a gray area with fraud, but it isn't legit, and could cause you some real problems..........this may apply to tags as well, but I don't know what state you are in, and the law will vary from state to state.............................

At the very least, any claim she could make to the insurance company would be denied on her inability to provide appropriate documentation proving that she was the insured. Plus the fact that she's dead.

When I investigated insurance claims I had to talk to both the owner of the car and the person on the policy. I would try to revoke your policy for material misrepresentation and fraud.

it is illegal yes. Your sister could be in a lot of trouble. Should she get into an accident and the insurance company were to find out that the policy holder was deceased, they could refuse the claim.

I would really recommend that she find a way to get everything in her name. I used to work for a cell phone company & w/them, it was required that the cell phone be cut off in the event of the account holder's death (although I'm sure many people didn't report it & kept the phones on). But driving a vehicle & keeping the insurance & tags in the deceased's name is a little different....that would just scare me too much. Because she is no longer the driver of that car. I may recommend speaking w/a lawyer. Was there a will leaving the car to her daughter? Good luck with this!

you can't do things in the name of a dead perons, thats just illegal. You shouldn't have any problems getting the title changed (unless there is a will involved or you are trying to avoid inheritance taxes)
