if his car insurance takes care of your car then there is no need to unless there was broken bones or something but you have to make sure it was his fault and have pictures of the damages incase he doesn't decide to get your car fixed. going to need it in court no proof you get nothing |

Sure, here in the USA, you can sue anyone for anything. But if you've been paid by their insurer, you can't collect a second time from them. |

Yes, within reason. If the insurance company paid for your damages and there is no other restitution to collect, then why would you take them to court?
If the insurance company declined your out of pocket or injury claim, you can initiate a civil or small claims suit. |
