Car Accident No insurance?

a little more than a week ago i was in a car accident... it wasnt my fault it was the other drivers... she had a stop sign and we didnt but she didnt stop so i hit her... my car was towed... today we finally got the report back and it says it was her fault however it said that she had no insurance.... does this mean that my car insurance will have to pay... or that i will personally have to pay... what about where car is at ($60 a day) ? she has court but... people tell me that without her having insurance mine wont do anything...

You have little choice than to use your own insurance to cover this accident. This is exactly why you have insurance. Use it or pay out of your own pocket. Which do you think most people would choose? Whether your insurance covers the $60.00 per day depends on the coverage you bought. You need to contact your insurance ASAP if you haven't already. Always call the police first and then immediately notify your insurance company. ALWAYS !

Your insurance will cover the loss but only if you have Uninsured Motorist coverage. Call your broker/agent and confirm this coverage.

If you carry collision, your carrier will fix your vehicle. If not collision then a UC (uninsured collision only pays up to $3500 for repairs or a total loss). If you have neither of these coverages, your carrier will not assist as they can only handle what you choose for coverages.

If the latter is the case, your only option is a civil or small claims suit and I would get the vehicle out of the tow yard right away.

It sounds like the only way you can get your car fixed is if you had .Collision (collision pays for the vehicle damage if the other driver has no insurance), of course there is usually a deductible. Other than than, you can take her to small claims court if the damage warrants small claims. I suppose you can go higher up in the court system if the damage is too much for small claims.

Insurance companies specifically developed collision to pay for your vehicle damage caused by uninsured drivers (and damage from other types of accidents, so if you had collision,. the damage should be taken care of minus the deductoible.

Even if the other driver had insurance, the minimum in some states for vehicle damage is as low as three or five thousand. If your 25,000$ vehicle was totaled by a driver with insurance, you would only get 3,000$ from the insured party. Collision insurance will pay you 25,000$ minus the deductible, if you are hit by an uninsured motorist.
