Car Accident Question What should i do?

My friend got in a car accident in my car. He has no license my car has insurance. There is no police report and really sure other driver is most likely at fault. My friend told other driver he will pay thinking he was at fault because he had no license.The other driver and i have not made an insurance claim and both of us dont want to. i just called the police dept and told me that just because you have no license does not mean your at fault and no police report can be done because it was private property. Its been about ten day since the accident. My friend decided to repair other driver car . We took other driver to well known body shops. Other driver is being a pain and want us to pay for work not needed to repair her car.We are thinking not to repair it because she is taking advantage. What should i do? My Car has insurance and we know other driver is most likely at fault.

Sooo if you know the other driver is at fault, why have you paid for repairs? That was your first mistake

2nd mistake, not calling your ins company. Always Always Always call them. They are the ones who deal w/ this stuff everyday. They could have probably told you on day one if the other driver was at fault or not, and then case closed.

You can call you insurance company now and make a claim. They will investigate and determine fault. You probably will not get your $ back that you already paid for their repairs.

Take it as a lesson learned. Sorry

Your friend's mistake is admitting fault. It is the insurance company's job to assign fault, not your friend's. Second mistake is you didn't report this to the insurance company sooner instead of waiting 10 days after the fact. Have your friend get an itemized statement from the repair shop detailing the parts that need to be repaired as a direct result of the accident.
Also, have your friend make a general release note, stating that he will only pay for the portion of the bill that has to do with the accident and to further release him from paying additional charges that have nothing to do with it. Have the woman and your friend sign it and make a copy to give to the other driver.

in a case like this it is best for both you and the other party to exchange insurance information and let the insurance companies hash it out between them. because you are aware that you let someone drive your vehicle without insurance i am sure your insurance will frown on you, if both parties have full coverage insurance, let them decide who is at fault and go with that if you feel it is right otherwise you may find yourself being sued by the other party. this would be the safest for all involved . I am an owner of a body shop in KS and we deal with this everyday, if you take both cars to a good shop they can tell how much damage occured just by seeing both vehicles and taking pictures ( i hope you have taken your own set of pictures ) the insurance companies have adjusters that are very well trained at this and can resolve it for you. and then there is always the question of a deductible too remember,.

Your insurance company WANTS to protect your interests.

That's what you pay them for.

The reason they WANT to is because they provide you a defense when you're sued.

Therefore. Report the accident. Cooperate with them and DON'T EVER LIE TO THEM!!!

Just because your friend had no license doesn't mean he's at fault and it doesn't mean your insurer has to pay the claim. As a matter of fact, you may get paid by the other guys insurance for the damage to your car.

If you loaned the car to your friend, the loss will be covered, but you'll probably be cancelled for gross negligence (negligent entrustment of the covered auto to a known unlicensed individual) .

If you DIDN'T loan the car to your friend, coverage may not apply, but you'll be asked to report the incident as a stolen car to the police, who will arrest your friend, and you will be asked to press charges.

You're in a pickle, but I bet you won't do this again.

If she keeps pushing the issue, tell her that you are going to call your ins. co. for advise and with any luck, she will not want to take that route anymore. Good Luck!

Of course the guy is being a pain. I deal with these idiots every single day and they will always be a pain in the a** until you shut them up or shut them down. He knows you are over a barrel and will keep pushing -- pretty soon you will see a demand letter for medical 'treatments' show up in your mailbox. Just call the insurance company and let them handle this guy --- be warned: since you have agreed to pay for the other car's damages your company is probably on the hook to pay the entire claim.

Your insurance probably will not have to pay because a person with no Drivers License was driving the car. Most insurances will not hold themselves liable if the driver does not have a Drivers License, not wearing a seat belt, drinking, etc.

The other driver may think she has the upper-hand because your friend has no Drivers License.

What you could do .. is to determine the actual damage to her car. Get several estimates on just the damage which your friend did. Then .. tell her - or send her a Registered Letter - that you are offering to fix the damage done to her car in the accident on that date. At this time - do not mention the other damages to her car .. just mention the apparant damages done to her car at that particular accident. You need proof that you are offering to repair her car. Also - if there is a repair service which could tell that the other areas on her car, were old wounds .. it would be a great assett to you.

See if she will settle on that deal. If she says no .. then you will have proof that you offered to fix her car .. and that you offered.

Do not ever .. verbally, or on paper ,, give her any refusal. Also just say - I am offering to repair the damage done at the incident.
