I was parkerd along side the pavement, indicating to pull out; I had checked the mirrors and pulled out... Some other vehicle came around the bend going beyond the speed limit. I hadn't seen him when I checked my mirriors, so that concludes he must've be travelling very swiftly for that to happen. I have a witness account of this too... I pulled out and my veichle went into the side of his car. He at the time was adamant that I claim liability, and that was that. He wasn't also going to give me his insurance details, not till I insisted I be given them. Yet, he was quite persistent with gaining mine. There's also quite the bump on his vehicle, which was impossible for me to do at the speed I was pulling out in - which was only about 4-5 MPH. He also wanted me to go to the police station and claim liability... Was this my fault...?

First off all, you never admit that is your fault even if you know it is.
Secondly, never argue with anyone. If the person is giving you a hard time, you pickup your cell and call 911. No need to tell him/her what you are doing. He/she will get the hint.
Lastly, insurance companies claim can be tricky. Most likely they will see it is your fault because you should have been able to see him no matter at what speed. |

from what ur telling me no. its called no fault, meaning no 1 person is at fault. dont be intimitated, fight back. file a cliam too. if you go to court the judge will ask y u didnt do it to protect yourself. you have a witness with is always a plus |

Never, EVER, EVER claim fault for an accident, regardless if its yours or not. :) And always get the other parties info, even if they don't want yours! |

If you can show that they other person was driving at a high rate of speed _and_ this contributed to the accident, there could be some liability against the other person. It also depends on your state laws as to how this would affect the claim.
However, the witness needs to be independent, i.e. not know you personally. Also, they need to be convincing in that they _knew_ how fast the other person was going. Lastly, I've heard people say a million times that the other vehicle was speeding as they never saw it... then how did you know it was speeding? When people don't see a car before pulling out, they want to figure out why. They could not have just missed seeing the vehicle... no... it had to have been speeding. In otherwords, it's unlikely that the other vehicles speed will be considered as a factor in this accident. Possible... but unlikely. |

The fact that you did not see him is not proof that he was speeding. It's proof that you did not see him.
You had a duty to make sure the way was clear before you pulled out. The way was not clear - a car was coming. You did not see the car- You pulled out and hit the car in the side.
You are at fault. |

Anytime you have an accident, especially where the fault is in question, you should call the police and have them write an accident report. The officer will usually determine fault. Anytime the other person refuses to give insurance info, you should call the police. Your description of the accident, puts him at fault. Without a police report, neither of your insurance companies is likely to pay for damages, that's why he wanted you to claim liability. Never claim fault, let the police determine it. |

Many states say if the damage is over $500 get a police report. I agree with the other answerer never admit fault let the insurance companys sort that one out. And next time be more careful pulling into traffic glance around twice or three times, signal then pull out. |

I totally agree with what tequila lucky said. Never claim fault and since he was so insistent and didn't want to give you his insurance info you should have definitely called the police and had them file a report! |

if you drove out into the street and you hit someone then id say its you fault for not looking where you was going it dont matter if he was speeding or going five mile per you pulling in to the road its your fault should have call cop then and had it done when it happen then call your insurance company... if you didnt do any of these thing then its up to you to prove what was done |
