I was driving home last night (the road is a moving traffic road kind of like a turnpike) on a two lane road in the rain. A car was pratically stopped with no lights in the middle of the road the car in front of me tried to manuever around it but hit him and then I tried to manuever around the 2nd car but as I went to turn around the 2nd car I hit a two foot puddle and lost control of the vehicle and hit the 2nd vehicle on the left rear bumper and the left fender. The 1st and 2nd car had very little damage. Me on the other hand had extensive damage done to the front of my car. My hood was crunched, windshield was spider webbed, front right head light was completely shattered and that shows I tried to swirve. Odd thing is me and the 2nd car both have the same insurance company. I was thinking possibly the insurance will blame everything on the first car. The accident was not my fault and I was not tail gating I just could not control the vehicle due to the huge puddle and lack of room to move. I know insurance companies usually blame the damage to the 1st car on the 2nd and the 2nd car on the 3rd. I have no one to blam eit on and I do not have collision on my insurance. I do not have th emoney to fix my car either which is my means of transporation to college. What do you think the possibility is of the other cars getting the fault? You were at fault for the 2nd accident when you lost control and hit the other 2nd vehicle.
The answer to the rest of your question depends on what state your in. If you are in California without collision coverage your out of luck and have to fix your car yourself because its your fault.
It may be different in a no fault state. |

well all rear end accedents are your fault{driving,to fast for road conditions} you didnt have control of your car,soory to say but here in NY we have no fault so your insurance will pay for your car,their ins. will pay for theres unless they sue you probaly happen ,sorry dude but you were driving to fast and too close |

wonders what part of you hit two cars your not sure of..
your at fault for both cars you hit and yours i guess to could blame god for the rain and the wreck but i dont think he will be happy about it |

No Fault insurance is for medical expenses not collision damages.
I would try to go after the vehicle which was moving slowly without their lights on. Their insurance co. may say you were going too fast or was too close in order to avert the accident. Maybe they will eventually settle for a percentage if that person tells the truth and admits they had no lights on.
These days, collision insurance is not as expensive as liability. |

fault lies with 2nd driver and you...the stopped car [unless u prove no lights] not at fault because anytime you hit someone in back its your fault....long held insurance position...you were going too fast for conditions and could not stop...you can argue but ive seen ti time and time again... |

The car that was "practically stopped" in the middle of the road could have had a mechanical problem and may have been trying to get over, but if his battery was dead, (from a bad alternator or slipping belt) then he was stuck there. Problem is any time you strike a car in the rear it's considered your fault. You were driving too fast for the conditions of the road. You have to be able to stop the car safely at any given moment no matter what is happening on the road in front of you. |
