Car Accident... who is at fault?

ok so i am in the intersection when the light is green waiting to turn left, the light turns yellow, its been yellow for about 5 seconds and there is a car about 40 meters away and the lady speeds up and tries to run the light while i am turning, i am thinking the lady is far way its been a yellow light for awhile its about to be a red and she would stop...i am going to court on monday and i am a little nerves... who does it sound like is at fault, the cop gave her the ticket she is fighting it.

Sounds to me like she was at fault -- but on the other hand, it sounds like you're not a US driver (meters? What are they? ;)), so the rules may be different where you are.

Besides, probably no one here is a lawyer.

But it DOES sound like she was trying to avoid stopping, and you had started your legal turn long before she entered the intersection.

The only time you have the right of way when making a left hand turn is when you are in a protected left turn lane (green turn arrow). At all other times, you have to yield to oncoming traffic. However, both drivers have a responsibility to avoid an accident when possible. Maybe that's why she was ticketed.

Don't ever assume another vehicle is going to stop, just like you never assume a vehicle with its turn signal on is going to make a turn.

I'm thinking it's your fault. The light was still yellow, so she had the right of way.

She is at fault because when the light turns yellow you have to clear the intersection to make way for oncoming traffic.If that's what happened.I'm assuming she got a ticket for failing to slow down to avoid an accident.That doesn't necessarily prove that she was at fault.You could have turned in front of her during a green light.In which case you are at fault.Without witnesses it's probably going to be both at fault,in which case her insurance will pay for yours and yours for hers.You both probably will have to pay the deductible.Hope this helps.

I would say the female driver in the UK the law states an amber light means prepare to stop, not speed up in order to beat it.

I would say shes at fault..failing to reduce speed to avoid a accident..plus the cop gave her the ticket..don't let her attorney trap you,only say she speeded up..they will try to say you turned in front of her..and say it was your fault..be calm with your answers,and short answers..yes or no...don't give them a way to trick you..good luck.

It's her fault, not yours. She tried to rush and broke the law.

Sbhe's at fault, she ran a red light. A yellow light does not mean hurry up.

Well I think it would be her fault since she sped up to try to run a red light...Why are you going to court.. it doesnt sound like a big deal unless she ran into you or something
