Call the police, file a report (they probably won't come out), and then call your insurance. Let them hammer it out with the lady's insurance.

You were supposed to call a cop to get an accident report. Did you get her license plate? You can possibly get her for hit and run, but you need witnesses and hopefully some physical evidence, like her paint on your truck, or your paint on hers.

Dont know who you mean by "they" wont give a statement, but it doesnt matter anyway. You should have gotten all information from her (drivers lic number and ins info) and if lucky, the police were there and filed a report of which they have to give you upon your request. But in lieu of all that, notify your ins company and let them sort it out...thats what you pay premiums for. Yours and her ins companies will fight it out. Best thing is to go get 3 estimates and submit to your company. They will then go after her insurance company for payment. BTW: you have the choice of having the check sent to the body shop or to you directly...dont let them tell you different..even with an emcumberance on the vehicle. You MUST however have it repaired cuz the bank still owns it>

Did you call the police and get a police report? The problem with these kinds of cases is that often it's difficult to prove fault because it occurs on private property, not an actual road. I also find it hard to believe that your tires caused a skid mark in a lot where you were traveling under 10 mph, even if they were bald. You're going to have a hard time proving that to the insurance company too.

Always make a police report and always notify your insurance company. Let your insurance company handle everything. That is what you pay them for. (You might want to forget to mention that you left skid marks going slower than 10mph too) wink

Report it to your insurance and let them work it out with the other driver. The fact that the accident happened in a parking lot (as opposed to a public street) means the police might not let you file a report with them. My husband was involved in an incident where a driver backed out of a space at a very high rate of speed and hit my husband's car along with several parked cars. The police said they couldn't cite the reckless driver (even though he was unlicensed and uninsured) because the accident happened on private property.

Police will not take a report if it's on private property. Go through your own insurance for repairs, let them do the work of approaching the other insurance company...that's what you pay them for!!

Did you call the cops? I'm assuming from the word "statement" that you did. That's rough. They're in the wrong. If you didn't call the cops you always should in a case like that. Then they fill out a report and you have some proof. Otherwise its just their word against theirs.
