Hi,
about 6 months ago, my friend was driving my car. He parked and when he opened the door, he hit another car. Small ding according to him, windy day at the time.
Anyway, the lady of the toher car got his name, license plates BUT no isurance, no police report was done either and he gave a fake phone number.Well, this morning I got a call from the ladys insurance co./attorney office. They demand $600 from me (sounds like a deducatible of some sort) They asked me if I woned the car? I said yes.
They asked me if I was involved in this? I said no. Never seen this lady or her car. Or I dont know anyone by the name of "Peter Pan" whose this lady wrote down at the time
They asked me: Did I let "Peter Pan" drive my car I said nope. Dont know anyone with this name I asked back: Is there a POLICE REPORT for this matter because my own insurance hasn't asked me anything about this. The person on the other side replied: No, but we have to ask our customer first, blah blah (Then I hanged up)help!

Well, obviously you know who did it, and the fact he gave fasle information at the time means you have no way of fighting this at all. Pay the damage, and get your friend to pay you back, that is the cheapest course of action, and the one that will cause the least trouble. |

If your friend caused the damage, he should stand up and be responsible, rather than letting you get caught up in the mess. He was negligent for not doing the right thing when it happened, small ding or not. Tell him to fess up and deal with it. |

I dont know what your religioius beliefs or morals are.. but it absoultey DISGUST me that you would consider screwing this lady over for damage done to her car just because you could "get away with it". Personally.. i believe in karma and what goes around comes around... i could just never do that to someone..
As the owner of the car, you are absolutely responsible for any damage done by your car. As a good friend, your friend should pay you back.
If you dont take care of this.. you are a really bad person. I just dont know how people could look their parents and future children in the eye if theyve done something bad like this. Its pure selfishness and really really sad.
In a criminal level (which is really all selfish people think of) you have no way of kinowing if this lady called the police or not. They may have all your info right now.. and your friend and yourself could face some serious legal consequences for not cooperating. not to mention, if you dont pay here her insuarnce company can do serious damage to your credit history and even garnish your wages. Is this all worth it? |

Insurance fraud is a serious crime. Do yourself a favor, get the money from your "friend" and pay the bill. In the future don't let friends that aren't responsible enough to take care of their screw ups drive your car. Giving a fake number and info in an accident is just shady and opens you up to a whole bunch of issues. Stop lying to get out of this, you will only make things worse on yourself. Fess up and pay up. |

Your car, your friend drove it with your permission, you're liable. No police report, now it's a civil matter & you will get sued. Usually police won't file a report if the accident happened on private property anyway. Parking lot = private property.
Contact your insurance agent or a lawyer, you're into a bunch of fun. Your 'friend' thought it was okay to give false info to a stranger, what makes you think he gave YOU the whole story.
They still have your plate number & obviously know where you live & you are liable for the damages.
If you would have tried to get it straight just after it happened, it wouldn't be getting as bad now as it sounds. Next time you're totally alone with your 'friend' punch him in the head for the aggravation he's going to cause you, after he's chipped in his end. |

Your own insurance hasn't asked you about this because if you haven't turned in a claim they don't know anything about it. It sounds like your friend lied to the lady about his name and they got your name from your license plate. Since you own the vehicle it is your responsibility. (If you let someone drive your vehicle you also are letting them use your insurance). Turn in a claim to your insurance company and let them handle it. It is a property damage claim so there is no deductible for you. |

Well, first off I would call a lawyer...and possibly contact your friend. Since the car is your's and you let him drive without insurance, you are responsible...BUT with no police report and no actual proof that the damage to the car is worth $600 or that the DING actually caused that kind of damage. It's definitely something to talk to someone with some real knowledge of the law. In any case....you can contact your insurance company about filing a claim should it come down to you having to pay. Since you weren't driving the car your rates may not go up.
One thing going for you is that you weren't there, the lady has no description of you...just your car. You can always argue that she simply wrote your tag number down in order to keep from paying for the damage herself.
I can't believe that the woman didn't call the cops or file a report (you have like 24-48 hrs afterwards to do so) Most insurance companies won't pay a claim without a police report filed, which is probably why she contacted a lawyer. Your best interest is to do the same. Maybe even AFTER calling an attorney, giving them your friend's phone number. It was pretty crappy of him to have given her false information when the ding was his fault to begin with. Maybe you should be careful who you let borrow your car next time. (make sure they have a license and insurance that covers other people's cars).

they wont leave it at that ,you,ll wind up having to pay for it,id ask to see the dent or ding though,and ask my friend to help pay for it,that's a long time to wait to get something fixed,since she waited so long you may not have to pay anything on it,but if you do ask to see the dent and the estimates on the repair,good luck with it. |

This is the reason why I've learned not to lend out my car to friends. I don't even lend it to family members as they have their own.
As there were no police report, but the woman found you through the license plates; you may slip through this time, but do not be so congenial in offering your car when someone asks. I know how that woman feels, having someone damage your car and leaving you holding the bag. I had a new car, parked it in a supermarket lot, and when I got home, discovered someone had backed into my rear fender, scratched the paint off without a 'by your leave.' It cost me $600 out of my pocket to replace it.
You don't know to what extent that "ding" is, but if she's looking for $600, then I would say that she probably has to replace the entire door. Hard lesson, but you should do the right thing as what if it were you whose car got "dinged?" |

I used to be a GEICO claims rep. More than likely her ins. company will contact your insurance to be reimbursed if she paid for her damages through her collision coverage and YOU were at fault. Ask your friend where exactly was her damage. If the point of impact was in front of her car, she may owe you money! No police report doesn't mean no one has to pay up. I'm not sure what state you live in but find out if your state insurance follows the driver or the car. If it follows the driver then your friend should pay. She can easily find out what insurance you have from your plates too. I used to do it all the time. When another party reports a claim to your insurance company, they will try to conatct you right away. After several attempts with no contact is the only time when they will pay out if you are at fault. I think you need more details about this fender bender. Car door accidents are more complex than people think. |
