Car accident.. HELP!?

yesterday driving on a 2 lane 50mph zone road, i was in the left lane somewhat far back from a jeep driving behind a school bus. as the school bus was pulling over and slowing the jeep cuts over into my lane at nearly a dead stop just as i was about to pass them.. i then slam on my breaks but still hit her rear bumper.. seeing as how i was going 50mph and she was going no more than 5 when she cut into my lane. she now is claiming its my fault because according to CA law any driver that hits someone from behind is at fault? Am i REALLY at fault here?

No, you are not - but you might need a witness that supports your statement that she lane changed into your path.
People misinterpret the law - if she was in front of you and hit the brakes and you hit her - it would be your fault, but this is not the case here. That would be called "following too close", but you weren't following her at all - she cut you off.

ADDED - if you don't have a witness, try getting in touch with the school bus company. It's very possible the driver saw it in the mirror but didn't stop because they were on their route. |

no tell her to learn how to drive and goto hell
she is at fault. she preformed an illegal lane change.
before yuo can change lanes your must turn your signal on and wait to make sure its clear and safe before u change lane. she did not and did it suddenly therefore its her fault. did u call the police/chp??? |

there is NO CA LAW that anytime you rear end someone you are at fault. Otherwise people would have no reason not to check before changing lanes or pulling out in front of people. Does she look like somone who knows CA law. If she changed lanes I would think she would be lialbe for making an unsafe lane change. |

I don't know California law, but in almost all places anytime that someone rear-ends someone else, it is the fault of the person that is behind, as the distance was not prudent. If he had hit the side of your vehicle pulling into your lane it would be different.
Probably no one will see it your way even if you are right.
