Car accident. Who's Fault?
|
there were 5 cars total.I was on the freeway. The first car braked and swerved then the second car hit him and they went off to the side. Then the 3rd car slammed on their brakes (but never came in contact with the 2nd car), the 4th car hit the rear of the 3rd car, then i hit the 4th cars rear. I was not hit from behind. Who's at fault?

It doesn't matter what happened in front of you, you are responsible for the car that you hit. It is your responsibility to maintain a safe distance from the car in front of you. |

Youre at fault for the car you hit. You have a responsibility to drive at a "safe following distance" in order to avoid hitting obstacles and other vehicles. |

You hit the car in front of you then is your fault. Regardless if someone pushed you. Also the car you pushed into some else it is your fault. Multi collisions are costly. |

Always the car from behind, sorry to tell you. Truly, you are better off talking to your insurance provider. From the sound of it, unless the 1st and 2nd car can prove what caused them to brake, your at fault for the second incident. I would not bother fighting it in court when the case is clear. On the other hand, just thank god you are alive and nothing happened to you. I was in an accident in 2006. Some idiot didn't tie their couch down, it fell onto the highway and as the cars in front of me reduced speed, I was forced to reduce speed as well to avoid the couch. A man hit me from behind because he couldn't slow down on time. He lost, I did feel kind of bad for him, because we both explained that a car in front had dropped a couch. According to the police and his insurance company, he still had to pay me, and the people who didn't tie their couch down got away. Maybe there is a highway cam that the police can view to show how this accident happened. I am reallly sorry, but thank god you are fine, really. |

These are 2 separate accidents. The 2nd car is at fault for that accident. Then, the 4th and 5th (you) are at fault for the second accident. Since the 3rd car never hit the 2nd car, it is not the same collision. You are at fault for the car you hit - possibly a small percentage of fault for car 3, if your impact with car 4 caused more damage to car 3. This is why you have insurance (hopefully) - they will sort it all out. But, you are at fault. |

technically....you should not have been travelling so close ... if you were two chevrons back...you would have seen the hazzard...so sorry - you will be at fault. |

You are, as was any other driver who rear-ended another vehicle. This was 3 separate collisions, not just one. |

You are at fault for the person you rear ended. You didn't leave enough distance between you and the car in front of you for you to stop in case something like this happened. This is why we don't tail gate! |

everyone except the first and third car is responsible for the car they hit. the first car and third car did what they were supposed to do to avoid an accident, everyone else was either following too close, not paying attention, had worn brakes or tires, or talking on the cellphone too much to drive safely. each of you should have had more distance b/w you and the car in front of you. |

the answer will vary from state to state generally, but from what you describe, you would be at fault. In most states, if you connect with the car in front of you, you are deemed automatically at fault. Since you were not hit from behind, that makes it more likely that you would be at fault in your state. Some states have "no fault" laws and some states will allocate fault in percentages.
you should be able to get specifics from your state from your insurance agent. |
