About a month and a half ago I was on my way home from work and this lady ran the stop sign on an exit ramp and hit me and totaled my car. I sustained whiplast from it and have been in treatment and my nect tends to be stiff alot. Also I am possibly suffering from PTSD from the car accident. Is it worth it to sue for pain and suffering and mental anguish. Also I couldnt work because of my injuries to my neck and I had to take time off and when i was suppose to go back to work I ended up not having a job because of the economic situation. Any input would help thank you. By the way I am only 17 so i dont know if i will sufffer from a stiff neck for how long and how long i will be suffereing from ptsd.

You are what made the insurance higher and higher every year.
You should sue, if your neck continues to be stiff and hinder you from performing everyday activities and your job.
Losing your job sounded like it had nothing to do with the accident.
PTSD - Are you serious? If you didn't see your best friend's head get decapitated in the accident, what traumatic event did you witness?
It really sounds like you want to CASH IN on this accident, and I just wish you don't. I think you deserve some compensation for your suffering, but any lawyer you talk to will want to go all the way - PTSD and anything else they can dish out.
Go to a chiropractor for your neck. I know it takes a long while to get your body back to normal, but you're young. You'll live. |

First, you are only 17 so you cannot sue. Your parents would have to file. It is sad at your young age you have already become litigious.
Why are you thinking about suing anyway. Have your parents called the other parties insurance company to advise you were injured? What have they said/done? Have they attempt to resolve the claim with them?
Just because you may have been injured does not mean you are entitled to any monetary compensation. The tort threshold requirements vary from state to state. Some are verbal, others are monetary and in some your injury must be serious. From what you describe your injury is not serious. What state did this loss occur in?
You claim you are suffering from PTSD. Do you have any medical documentation in support of this allegation? If not, don't expect any compensation.
Assuming you are tort eligible, your claim will be evaluated once you have stopped treating. Since you are only a minor, a judge will have to approve of the settlement. This is called a 'friendly suit'. Usually the insurance company will handle all of the paperwork.

I would not jump to the conclusion that you have to sue. Suing is a big deal for you and your family and the other party involved.
Are you seeing any results from the treatment that you are getting? If not you may have to see someone else or ask for a referral to another health professional. It is good to do this to estabilish and document that you are actively seeking treatmenf for this car accident.
If treatment is not successful, you may also be given a disability- meaning that you may have some limitations of working. This depends on the pain that you are feeling, your overall mobility (range of motion in the neck for example) and your ability to carry out your activities of daily living.
If you think you need to see any attorney, you could go for a consult.
Ask the Dr that is treating you for advice as well.
Your Mom is going to be an important factor in all of this- So I would share with her how you are feeling, if you are getting better or worse.

Yea you should sue. I mean, did u have insurance? If you have the correct police reports saying that the woman ignored the stop sign you can sue her.
age shouldnt matter in court of law, Since youre 17, you will need to talk to your parents and the family lawyer. If you can make a profit from this go ahead. |
