Car accident, crashing at others back always wrong?

I have recently involved in an car accident. The driver cut into my lane without signaling an i horn at him. Then, he got very unhappy and tries to block my vehicle from moving in front of him. He made several jam brakes deliberately and i miss the first two which then at the third time, he made one that came to a complete stop which then cause me to crash to the back of the vehicle. The road infront of him was empty and there's no proper reason for him to jam the brake.

My question is, is the vehicle at the back always at wrong regardless of what causes the accident?

Your fault I'm afraid. Your blowing the horn at him caused him to go into a road rage situation, which was obviously wrong on his part. Since you saw that attitude, you should have slowed down and allowed him to go. By not doing that, even when you saw him putting on his brakes in an attempt to make you crash, that put you at fault for following too close. If you have backed off far enough he couldn't have caused you to do any damage. If was your insistence that you were going to pass him that caused the accident.

Next time, slow down, back off. If you have to, pull over and stop to let them go. If they stop and threaten you, call the police.

Sounds like what we Americans would call a case of 'road rage', in which the driver in front of you deliberately caused the accident. Was the accident reported to the police? Have you talked with your insurance company? You may need an attorney to argue this one for you.

No, the rear vehicle is not always wrong. However, without evidence to the contrary, the vehicle behind is usually blamed as you have a much better view of the road ahead than they have of the road behind.

When he cut in front of you, you should have realized he wasn't paying attention. Once he tried to block you and especially once he jammed on the brakes the first time you should have just backed off as much as possible and let him go.

You can be completely and totally in the right and still get fuc*ed.

Most of them time when someone rear ends you-its always their fault. But what he was doing was reckless driving. Did you guys fill out an accident report? And if so it just depends on what the officer wrote.

i think this will be considered your fault. if he cut you off and was deliberately braking in front of you, as you stated, "several" times, why didn't you slow down, back off and let him go? it sounds like BOTH of you had road rage

Yes if you hit someone in the rear you are at fault. You could claim you were a victim of accident fraud and get a lawyer.

Actually according to the law if you rear end someone you are at fault,is it fair no is it the law yes.

The standard answer is yes, it is always the rear vehicle at fault....it's called "following too close"....you can go to court and try to fight it, it will boil down to who the judge believes.

Yes, usually that's how an insurance company sees it. Sorry. I hope you can prove that it was indeed the other driver's fault.

Most of the time yes. It depends, once my mom was behind a vehicle (not moving) in a car wash waiting to go and then all of a sudden the car in front of her backed up and crashed into her. The person in front ended up taking the blame for it so it isn't always the person behind who gets the blame. In your case, it was the person in front who should get the blame. Unfortunately, I think you're going to end up with the blame unless you get other witnesses.

usually yes - but that's some serious antagonizm for his part - you should note all of this with the police and explain it to the judge and your insurance company

they could believe you and charge the other driver with reckless driving causing an accident..
you should have backed away immediately when you realized he was messing with you though.. but still sounds like he was the cause of this not totally you

I totally agree with you, the driver at the back is not always in the wrong. Having said that the way the athorities will look at it, will be that you should have pulled back and not got involved with the stupid ****. I sympathise with you, there are some right idiots around.

Yes most of the time.If there is no witness to the accident then it his word against yours.Road rage was the problem.You can go to court and fight the ticket but I feel that you should have backed off from the vehicle or turn away from that person.It a learning lesion.Good Luck.

No, you can prove this was road rage directly at you and that what has cause the accident. Get a police report, submit to your insurance the way it happen. Tell your insurance company you want to sue him but they won't help you so get an attorney NOW. Do not delay on this or you will be stuck with accident being your fault and cause your rates to go up. Make this guy be responsible for his actions.

I don't know who thumb downed most of the answers but they are clearly wrong. It is always your fault unless you can PROVE it was a fraudulent accident.

yes it is always ur fault i would like to kill people that do that the reason it is always ur fault is because the police say u were following too closely if that happened to me i would have gotten out and beat his a** but that is just me.
