Car accident during driver-ed training?

During my son's on the road driver-training with a professional driving school (in school's vehichle), he got into a car accident. Another car hit them from behind while he was turning right. They stopped, but the car that hit them took off (hit and run). The driving instructor said that he will file a hit and run report. However, what's gonna happen to my son's driving record? The instructor said we don't need to do anything, Is that true? Do we need to file a report with anyone?

A report needs to be filed. Two reasons:

1. protect your son against other people making an injury claim against him. You know, there is always a cheesy attorney willing to make a frivolous lawsuit against you. If you have a police report, you can document that he was not at fault (not even one percent). This just could be one of the most important pieces of evidence that will help you in the future.

Do not worry about your son's license situation. He was not at fault and you can document that now. It will be too late once an attorney gets his hands on it.

2. Perhaps more importantly, there is potential liability against the instrutor and his/her company. If your son is injured, they could potentially be negligent. They were teaching him how to drive and got him into an accident. Or the instructor can try to make a suit against the driver (your son). The hit and run driver could try to go after the instructor an his/her company.

In either case, it is always better to file and have that report in your side. Insurance companies also require reports to be filed before they pay for vehicle damages in hit and run accidents.

Why would you have to file any type of report? It isn't your car, and surely wasn't his fault. A hit and run to a stopped car is never the fault of the car that is stopped.

If it was parked, and he was the last one in it, and it was hit, would that be his fault? Same thing really. Listen to the instructor, he has no reason to lie to you.

It's not your son's fault so it shouldn't affect his driving record. If your son's instructor files a report, the police might need your son's statement too.

No you don't have anything to worry about. The instructor wouldn't have told you not to worry if you had to file a report. I just hope the idiot who hit him turns themself in.

not your sons fault. the law says that you have to have your car under control at all times and for sure the person behind him did not.

The fees for driver's ed training should include full coverage insurance to cover anything.
