If you were established in a lane and they just pulled out and hit you sounds like they were at fault. but just to be safe you might should check with local authorities. |

Without being there to witness the accident, I'm going to say it sounds like the other driver was at fault.
And btw, Caitlin has a point...the other guy's insurance company may try to pin some of blame on you, saying you weren't paying attention and should have noticed it and avoided the collision. |

Without knowing all the details of the accident, I can't tell you. It's up to the insurance companies to decide. I was injured in a rear end collision (I was at a full stop). My lawyer told me if I was moving at the time, his insurance company would try to pin some of the blame on me. Because you were moving the other insurance company is going to try to say you were partially at fault to avoid paying all the costs, even if it was all the other driver's fault. |

I have friends in the insurance industry and the first thing they look at is where your car got hit. This doesn't mean the following is definitive,but it's a guide they use. If the front half of your car got hit--they may put more blame on you whereas if the back half of your car was hit then the blame goes to the other person. |

It just depends go to your local police department and get a copy of the report, that should tell you who is? Then take to your Insurance company to get them to pay you. |

It is not your fault if you didn't change lanes. You need to turn it in to your insurance company so they know about it and can determine that it is not your fault. Then they or you need to contact the other or their insurance company so that you can be paid for your damages. |
