Car accident... how to deal with people like this...?

i've just been involved in a car accident lately... first of all ,i live in vancouver, canada. it is true that i hit the back of this car... but the thing is... it was downhill, raining and my brake seemed to have a bit of problem... i don't know... i havent changed my brake for 7 years.. and it worked fine most of the time... and today i donno what happened, just couldnt stop completely and ran into the back of that car. however, there was no demage on the car.. and ther person is like " the car is not really damaged, but my neck..."and he said it so fakely... i admit no matter what, its still my fault... but im sure he cant be hurt just because of that... because i've been hit before as well... and it was much faster than this one... and i was completely ok..so right now, he has got my driver's licence, license plate and my phone number ,and i have done the same... he said he'll declare if his neck has problems....
i'm just thinking how to deal with people like this...

7 years? It is a wonder you are still alive. You should be ashamed of yourself waiting for something to go wrong before thinking about getting service on your car. Brakes should be checked regularly to ensure proper adjustment, and that there is enough life left in the pads/linings to drive safely.
The person will make the claim with I.C.B.C, and I suggest you make your report BEFORE they call you in, it looks better for you. And dust off your medical degree, you are going to have to show it if you are going to make medical assessments of the other driver.

It dosnt take much to hurt a persons neck -- & sometimes takes days or a week to show signs of injury -- hemay or may not be faking - so don't doubt it - you were in the fault - following to close - I know hard notto do in some areas of vancouver - I've lived there & been rear ended by a delievery truck following to close in the rain. Be more cautious wether nice or rainy weather have at least 2 car lengths between you & the next car - when possible & drive as deffenceivly as you can -- its scary on the roads espically last timei was in vancouver !! LOL

Neck and back injuries are different for everyone. Something that might not affect you may be very painful to someone else.

Your stating that your brakes "worked fine most of the time" says that you knew there was a problem with the brakes and therefor you were setting yourself up for just this thing.

unfortunately, you are screwed...first, how can you assume your brakes would last for 7 years???? second how can you assume the other guy is not hurt when you hit him rolling downhill at an angle??? even if he is lying he can do it until he is PROVEN to be lying, which you cannot do...th law says you are to be in control of your vehicle at all times and this is no different...heres the one good thing where you shouldnt have to worry...its called car insurance!!! now that this guy has all your info, did you call the cops first???? or did you volunteer your info without cops??? sounds to me like you have bigger problems than a simple car accident

go take a few pictures of his car ,,give your insurance agent copy's (of the pictures)..Tell him this guy might be up to something

As soon as he got into his car, you should have rammed the back of his car again, making sure that his neck will be in the condition he described! :)

Hahaha, nahhh..just joking (though it seems like a good suggestion).

Make a police report and make sure that you also report what he told you during the accident. Then, inform your insurance agency of the incident. Keep a close tab on reports made against you/your car, so that you wont be caught with your pants down. Also, make sure you report that you were travelling around 20kmph when the incident happenned. :)

WELL I LIVE IN TEXAS AND THE WAY IT IS HERE IS ALTHOUGH THE TESTS AND X RAYS SHOW NOTHING IT DOESN'T MEAN HE DOESN'T HAVE PAIN AND SO THEREFORE IT IS ALL UP TO HIM. KEEP IN MIND THAT IS HERE IN THE U.S. GET A LAWYER THOUGH BUT IF YOU DON'T WANT TO GO THAT ROUTE AND DON'T HAVE INSURANCE AND YOU HAVE TO PAY HIM THEN BE SURE TO ALWAYS GET IT IN WRITING AND EVERY TIME YOU PAY HIM GET A RECEIPT. Got insurance?If so,explain to them everything and let them fight with you.Got a lawyer?You might wanna check out a pretty good one if the guy's gonna try to milk this thing for lotsa moola.I would also wanna see medical records for any claims he comes up with and,oh yeah,you might wanna get your brakes fixed....I mean ..7 years?

FILE A POLICE REPORT AND GET ALL THE DETAILS ON IT NOW FOR YOUR PROTECTION AND LET THE INSURANCE HANDLE IT.

WHEN YOU HIT SOMEONE FROM BEHIND NO MATTER AT WHAT SPEED YOU WILL ALWAYS BE AT FAULT, EXCEPT THE ONLY TIME THAT THIS IS NOT TRUE IS IF THE PERSON IN FRONT IS BACKING UP AND HITS YOU.

AS FOR THE INJURIES IT WILL BE A WAITING GAME AND MAYBE THEY ARE INJURED BUT IF THEY REALLY ARE THEY WILL HAVE TO PROVE IT COMPLETELY.

SO AT THIS POINT YOU REALLY CANT DO ANYTHING BUT WAIT.

I completely understand how you feel. My mom got hit in the back, in a parking lot. She was turning and backing out, and was completely stopped. The guy lied about her. I would suggest just keep faith and fight hard. You know what happened, and I hope the truth comes out. :)
