Car accident, my fault, my insurance company not paying for one of the cars involved. what to do?

I was involved in an accident involving 3 cars. It was my fault. I'm fully insured. My car and one of the other cars in the accident are being repaired with my insurance company. The third car involved, which is a taxi had little damage around the tires and was not towed on the scene of the accident. The cab driver is now claiming 1700, after repairing the car without talking to my insurance company and without his damage estimated.
He is calling me and telling me that my insurance company is not answering his calls and they are not handling his claim. He is calling and telling me that he is going to sue me. What shall I do? At the scene of the accident I gave him my insurance card, should I get involved in this. Please advise me. I'm really worried.

No you should not get involved in this. The thing about cab companies that everyone needs to know about is those cars are ALWAYS damaged. Because of this they don't want to deal with the insurance company b/c the insurance company can see through their b.s. when the car is inspected and they attempt to claim prior damage that is not related to the accident you caused. They are contacting you b/c they think you won't know the difference. Call your insurance company, give them the cab info & contact person who's been calling you or sending you letters, and let your insurance deal with it...which again is what the cab company doesn't want.

Do not respond to this idiot. Call your claims adjuster and advise him/her about cab-guy and they will handle it. Your insurer probably has denied payment due to the fact that they were not given the chance to inspect the damages on the car. They will tell him to go to his own carrier and see if THEY will pay the claim, then your company will settle it through subrogation. Don't worry about being sued -- your insurance company will have their legal staff assist you if it comes to that (which it won't).

There really is no need to worry about this as long as you have enough coverage dollar-wise to pay for all the damages.

Taxi companies are well known for being difficult to work with on claims. This is why you have been paying all those insurance premiums over they years. Your insurance company has a duty to defend you if the cab company sues you.

If the cab company calls again gibe them your companies ph #, adjuster name and claim number then terminate the call.

Then call your adjuster and find out what is going on as far as communication with the cab company.

Relax a bit life is full of stuff to worry about, but this situation should be way down on the list. Let your company deal with the cab company.

Tell the cabbie not to call you anymore and to contact your insurance carrier directly. If he does not listen to you then YOU need to call your company and explain to them that this guy is harassing you. They should then jump on the ball. If you get nowhere with the adjuster then request to speak w/ a manager or supervisor. Ask them why they are not contacting the 3rd vehicle involved and what the status of the claim is.

Three car accidents can be tricky. How was the taxi damaged? Did your car hit the taxi or did the second car? This matters. If the second car hit the taxi, your car did not cause the taxi damage and your insurance company has no obligation to even talk to the taxi owner. The second car's insurance should cover the damage despite the entire accident being your fault. The insurance companies will then argue (let them) over the cost, etc.

You should let your insurance company handle it. The other party has a legal duty to support his damages, therefore he has to supply photos, an estimate and a receipt that he repaired the vehicles. Most likely your insurance company has advised him of this, but he is disregarding it because he probably either a. didn't do the repairs or b. had no damage and just wants $1700. Even IF he does pursue you in small claims court, your insurance company will provide you with all the support you need to back up your case. DO NOT GET WORRIED. And do not give in to the taxi-cab driver, if he calls you and you answer, refer him to your insurance company. If this does go in front of a small claims court judge, and the taxi-cab driver cannot provide any documentation to support his damages and the repairs that were done - he won't get a penny. This is why you have insurance - you want them to pay what is fair. If they paid every claim that was fraudulent - insurance premiums would skyrocket. Does that make sense? good luck.

You have a right to see pics of the damage and estimates. (judges like to se more than 1 estimate). Also, go to your insurance company. They should investigate the perpertradtor, as it sounds like he is scaming you. That is why you pay insurance. But FIRST start with your insurance company your self.

Call your insurance company..they should have to handle it...if they don't sue the insurance company...be sure to let them know the 3rd driver is threatening to sue you and if that happens they are next.

Ask for the repair bill so you can see exactly what the damage cost. Keep in mind: he is under no obligation to give you multiple estimates, to hunt around for the cheapest repair shop, or to go to any shop that you suggest. When he gives you the bill you can submit it to your insurance company, but if they don't cover it you will have to. Maybe he will be nice and work out a payment plan with you (get it in writing!) but he could sue you. And, since you say it's your fault, he will likely win.

Might as well get alawyer cause you're probably going to get sued and lose because the accident was your fault. I suggest writing a check for $1700.
