ok so i am in the intersection when the light is green waiting to turn left, the light turns yellow, its been yellow for about 5 seconds and there is a car about 40 meters away and the lady speeds up and tries to run the light while i am turning, i am thinking the lady is far way its been a yellow light for awhile its about to be a red and she would stop... and she hit my car and totaled. i am going to court on monday and i am a little nerves... who does it sound like is at fault, the cop gave her the ticket she is fighting it. i am going as a witness.

Her fault... she run the red light, but makes no difference to you. As a witness yo will just tell the court what you saw. |

Tough one. It might go either way. She could deny attempting to run the red light and say the light turned yellow as she was entering the intersection. And since you were making the left turn in her path, the accident would be your fault. But I can see the insurance companies settling for 50/50 on this one or 70/30. If she's successful at fighting the ticket, it may not be good for you. Even if she's not successful, it may not matter. Insurance companies don't always agree with the police. They do their own investigation. I'm surprised you didn't get a ticket for failed to yield. The officer believed you other her? Were there witnesses? Witnesses would help.
You should never assume someone is going to stop when they should. Since it sounds like you were already in the intersection waiting for the left turn, you should have been more cautious. If she appeared to be slowing down to stop, then you go. If not, you wait and go after she passes. Even if the light turns red, if you're already in the intersection, you can proceed with the turn.
Insurance companies look to see what drivers could have done to avoid the accident. Your statement saying you assumed she was going to stop isn't going to help you. Basically, you could have avoided the accident by waiting to make sure she was going to stop before turning. |
