Car accident witness problems?

i was sitting at a junction when a girl cut across the corner and scraped the corner of my car, straight away she got out and started to complain of head and neck ache!!! there was a lady in a car bout 20yrds behind me who said she didnt see anything but because the girl was makin such a fuss, the lady said she would be her witness to the accident!!! there was a man there who told me he didnt see anything but he heard the lady say she didint see anything but is still going to be a witness for the girl, so i took his number so he can tell the insurance what he heard. im so worried as now she has a witness who is going to say its my fault even tho she didnt see anything.

Tell your insurance company exactly what happened and what your concerns are - they deal with this sort of thing all the time and can give you much better advice than anyone here.

Sounds like a scam, tell your insurance company what happened, they are use to scam artist.

She's just trying to get a sympathy vote by freigning injury, she's an erse. Just tell your story of how it happened and hope her event leading upto the accident match yours and you'll be fine.

I had a similar thing a few years ago when a bus hit me, there was another driver talking to him at the front of the bus and his arm was broken in the crash, i got a letter from this guys lawyer saying i was responsible for his injuries, i passed the letter to my lawyer pointing out all his injuries were on his left side proving he was facing the driver when we crashed and given there is a notice in the bus which states, 'Passengers must not stand beyond this point or talk to the driver without due cause' so the driver was hit with the insurance and the compensation for his own colleague for allowing him to talk to him while driving

You don't get head and neck ache from a scrape on the corner of your car - only from a rear shunt (whiplash), so don't worry.
Tell your Insurance company and report the accident to the police - and don't worry, it wasn't even your fault!

Make sure you draw a picture (photo would have been better) of the exact positions of the cars and the junction markings at the time of the accident. If you can show your car was in the correct position and stationary at the time then you have a strong case. If your car was not in the correct position then it could be a contributary cause of the accident.

Notify your insurance company of your concerns about this incident - they do take a dim view of Insurance fraud. Similar thing happened to me a couple of years ago and whilst the insurance did pay out they reduced the payment down considerably. This woman is trying to make a claim for Whiplash and insurance do know that headaches from whiplash takes more than 24 hrs to come on. Unfortunately for you this will go against your insurance because you do not appear to have any witnesses to back up your side of the story. Moral is : keep a camera in your car at all times and a mobile phone on you so that you can call police.

The physical evidence is very telling. Additionally, upon interviewing the witnesses, they'll know what the witness saw & didn't see.
