We had just purchase a new car in November 2008 on Jan 15th a driver was going to fast for conditions hit a total of 5 parked cars in a car pool lot.... After 3 weeks of dealing with their insurance company the settlement they are offering will not buy a new car let alone pay off the loan when we purchased the car it booked for 23,000 we financed 17000 and now they are wanting to pay 16,000 we are going to contact a lawyer to go after the difference to be able to buy another new car since just wondering if anyone is aware if we will get anywhere since they were totally at fault and driving too fast for conditions in icy weather.

Yes I understand that my new car is no longer new but it would still be my new car if the person driving too fast wouldn't of hit it in a parking lot. I still have the window sticker for the car and total vehicle price is 23180.00 that is not what we paid nor what the financing was for I am contacting someone to see if the company can be held responsible for what their insurance company does not I understand the process of actual value but that doesn't help that finding a car just like mine in their price range and miles isn't something that is possible at this point and help replace the money we took from our saving to be able to purchase this car which is now not available for another one.

Don't waste you money on a lawyer. You can do whatever a lawyer could do. You will be paid "fair market value" for your car and it makes Absolutely no difference how much you paid for the car or how much you may still owe for the car. That has nothing to do with it. You can, however, try to negotiate a better price for your car. If you try, get a couple of car people to write out an opinion as to your cars value. If you end up getting less for the car than what you still owe on it, you will still have to pay until the loan is satisfied. |

Just one more example of insurance companies being greedy. Let them know you are hiring an attorney to get your money. After you get that big check of course. You get a lawyer be sure to sue for loss of use of your vehicle and emotional stress from it all, on and on. They will pay more to go to court than to pay you off. Hope you get lots of money. |
