Car insurance/accident?

Hello,

I had a car accident yesterday. I believe I am not at fault and the 3rd party as well. Damage to my car is below my excess and I have found a good garage who will repair for a well below excess price.
I therefore told insurance, I will not claim.

My policy runs out in 2 weeks. And I am starting a new insurance with another company.

I am off for for holidays abroad for next 4 weeks. I have sent a statement to my insurance on what happened and from my point of view i was not at fault.

If the 3rd party makes a claim, will the insurance need me? Will they need any documents etc as I will be on holidays. They said its fine, they've got my statement.
But i am quite stressed as i'll be far away.

Does anyone know what happens if the 3rd party claims?

P.S Do not usually get 4 weeks hols, didnt take any this year. lol thats y want to avoid stress. I am a stresser.

Is there a police report or witnesses? In the US if an accident involves $500 damage or injuries it must be reported. It takes very little impact to create $500 in damage. A police report or a witnesses would ensure you are not in a situation of "your word vs theirs".

The details of the accident are what will determine who is at fault. If the other person places a claim against you & there are no witnesses or police report the insurance company will determine who is responsible based on the details reported to them. They will correlate the accident info with the damage on both cars and get a pretty accurate idea of what & how it happened.

You can't stop the 3rd party from placing a claim but the insurance company will not pay anything if they don't have to. Any at fault accident will affect your insurance rates whether or not the insurance co. has to pay out.

I was in a minor crash about a month ago - I am claiming on my insurance. I firmly believe the other driver was at fault.

Guess how many times I have been contacted by the insurance company since all this happened? Not once.

I suggest you talk to your current insurance carrier as they would be responsible for any claims. This is a legal question which requires knowledge of which jurisdiction you are in and the auto insurance rules there. I don't think this forum can answer such legal questions.

So talk to your insurance company.

BTW in most accidents someone is at fault either you or the third party. Someone must have done something wrong. Fortunately since there is no claim there will likely not be an assessment against the rating of one of the drivers for an at fault accident.

are fully comp or third party ?, if your fully comp you may have a solictor built in with your insurance and they will deal with it, but don't worry leave all your worrys at home when ur on your hols.

if the accident wasn't your fault then your insurance don't have to pay for the other car or anything, so their insurance will be responsible for paying for their car if it was their fault

ive been driving 40 yrs...go on vacation and don't worry...didn't the insurance co say don't worry? now i say it...if you want to [but don't need to] call them and tell them your plans..and how to reach you or just you'll be away...now wasn't that easy...relax...4 week??? WOW

They need documents supporting damage to your vehicle, witness statements to the accident and documents supporting any injuries caused by the accident to people in your vehicle. You should tell your vehicle insurer who you are insured with for travel insurance.

Hiya Chick.

I had a crash last week too. Well my partner did, but it's my insurance. The 3rd party in our case is a garden wall! But nothing ever happens quickly! As long as you make your insurance company aware, you will be fine.

It will take months for claims to be settled. If both parties dispute the likely outcome will be 50/50 split liability.

even if the 3rd party does make a claim it will be months before it gets sorted. Don't waste your time worrying whilst you are away on holiday.

Not sure what country you are in but in the UK, if you tell your insurance company you have had an accident, but all was ok and no one is claiming, they still put your premiums up next time, so check your new insurance company dont do this, as they tend to talk to each other about claims.
I hit a guys wall last year and did all the statement stuff over the phone, I gave the guy my insurance details and he delt with the insurance direct and I wasnt involved. the claim is between the third party and your insurance NOT YOU.

You believe? No offense but some people believe in UFOs. It does not matter how you feel or what you believe. The only thing that matters are the facts and the law in your jurisdiction. Since we are not privy to either, no one here can answer your question correctly.

When you have an accident you should always phone the police. Allow them to take the info from all parties and make an assessment as to who is at fault. They will also offer all parties an ambulance if injured. If people decline, they have a harder time proving injuries later on.

Any of the other parties could make a claim. They could hire attorneys also. At this point, it would be a civil case and either the insurance companies will battle it out or it will go to court. If it goes to court the judge or the jury will then decide who they think is telling the most truth. Basically a popularity contest. If you are right and have a criminal past, the judge won't believe you. If you are right and the other person is prettier or more distinguished, more famous or a priest of a nun, you are screwed.

This is why you should phone the police when you get into an accident. They are paid to patrol the streets and part of their job is taking accident reports.

Was there any police report, with all the information and details filed? Was there any witnesses that left their info to be put on the accident report? Were there any known injuries at the time? If no to the first two questions, its your word against his. You sent a statement, they possibly will need a official inquiry statement from you. Since your insurance rates hinge on your driving record, you may want to call and inquire about any of this, and let them know how to contact you during this time frame. Lots of people think their not at fault, when in actuality for obscure reasons are responsible in the laws or insurance companies eyes. Since your changing companies you don't want to find that your tied up in some litigation which might hamper the new company wanting to accept you as a customer due to you not being able to simply sign some document to complete any processes that may come up during your vacation. Make sure the person your talking to is competent in their job and not a receptionist filling in for a short staff or extremely busy office. If you have been advised wrongly, you are the only person that would be hurt by all of this.

You should always file a claim. That's what you've been paying those guys for.What happens if the other party claims you hit them and there's $5,000 worth of damage?You should also take photos of the damage to your car.Yes, they may need to talk to you as to what happened.
