myself and my partner were in a car accident at the weekend where a lady pulled out on us causing us to swerve and hit a wall. After driving off the woman was caught and admitted liability. Her insurance rang us and said that because we didn't hit her car there is nothing they can do! Is this legal? Its was Direct line insurance that said this and the advisor said, i quote " you should of hit her car!" where is the justice in that? We have now lost 1 years no claims and had to pay £250 excess and our insurance is going up by £400 next year!

If the woman admitted responsibility either to a cop or you have it in writing you should get a lawyer.
Forget what these people are saying, nobody can be a danger to others and get away with it. Imagine you have a dog or a horse that causes a car to crash they'll come after you because you own the animal, it is the same thing.
You can even slide on a patch of diesel and if you can prove who lost the diesel you can sue them for damages.
Trust me phone the insurers and tell them that if they don't pay up you go through a lawyer and if they don't budge, get a lawyer, they'll pay up don't worry about it.
Insurers always try to get away with it at first. |

You lost control of your car and hit a wall. There is no reason why the other woman's insurance would pay anything. I don't see why you think they should. |
