Car insurance fraud?
Find answers to your legal question.

Car insurance fraud?

if somebody tells the police and their insurance company that their car was stolen but they did it themselves and threw some of the car parts into the canal to make it look like the car was stolen for parts what will the police and insurance company do if they found out it was the person lying? and if the person denys it would the police or insurance company go into the canal for the parts?

The insurance company always investigates. If they find out the person lied they will prosecute, and deny the claim, or if anything has been paid out, demand a refund.

The police will investigate, turn over the findings to the district attorney who will issue a warrant for your arrest. You will go to jail for car theft, and insurance fraud. Better have a really good criminal attorney, don't rely on the public defender to get you off.

They more than likely would retrieve the parts first then issue a warrant for his or her arrest. This type of thing happens every day , that is why insurance is so darn high.

well, believe it or not......a LOT of people "steal" their own cars.

Will they find out? Chances are really pretty good. Insurance companies are pretty good at sniffing these kinds of things out.

Will they go into the canal? yes. Evidence is evidence. Any charges brought against you need to be supported with...evidence.

What will they do? Press charges. Insurance fraud is a crime punishable under the law of most states.

This kinda thing follows you around..... not so good.

Hopefully.....it's hypothetical. :0)

Most theft adjuster are heavily trained in recognizing theft JUSt like this. The will grill you and grill you and 99% of the time if your lying... you will get caught. They arent idiots- they know how much fraud goes on.

But- they are the least of your problems. All that does it gets you in trouble for insurance fraud and no money for your car.

The police are going to be your major problem. ONce they learn you committed insurance fraud and faked a theft... you now have criminal charges.

yea, really sounds worth it huh?

Insurance fraud is a serious crime. The investigators are smarter than the person staging the crime. This "hypothetical person" is going to get caught.

They will 100% definately investigate the loss, up to and including attempting to retrieve the car. If the suspect/owner admits to doing it, they will be charged....but here's something not everyone knows....the insurance company will usually have to pay the loss payee for the loss no matter if you intentially steal, burn or wreck your car. You'll most likely never be able to get auto coverage again, but your car will be paid off and you'll be out of debt. This policy language is usually under the Comp/Collision section and most policies will have this language.

The insurance companies are in business to make money. If someone is trying to pull one over on them and "steal" their money through fraudulent means, they will do everything in their power to prosecute the fraudulent individual/s.

I doubt the insurance company itself would go into the canals, but they may have the police do it. Regardless, this person is in a bad situation. If caught, they may go to jail, may have an incredibly difficult time getting car insurance in the future, if ever... it's bad news.

Slap some sense into this person. They are why we pay high insurance premiums.

depends on how much they are expecting to scam out of the insurance company.
they will most definitly get arrested, and need to get a lawyer, and they still likely go to jail. It will be something that happens a few months or a year later too, not the following day, so it can come back to get them at any time.

Making a false insurance claim and filing a false police report is FRAUD.

The insurance company can cancell the policy, and the police would arrest the person.
