my mums car insurance company is tryin to screw her over... i need opinions please! the car got wrote off due to something smashing it from the back as it was parked therefore perpitrator was never found! the car was worth £500 which was 100 deducted for policy... then the insurance compony took the whole wak of 12 months insurance aswell when we only had the car for a month! is that fair? deucting that for £500 leaving us with 154.77... IS THIS LEGAL????

Yes it is legal.
Your insurance was annual (albeit was paid monthly), so they have recovered the cost of the policy.
For a car of that value for you to get 154.77 is a result, normally they would try and get it classed as no value. |

Yes it is. The price of the policy was quoted for a 12 month policy, but payable in instalments. Therefore, since the paying out for the write of effectively terminates the policy, the whole price of the policy needs to be paid off.
Cars rarely are paid their full insured value upon write off. This is because cars depreciate in value.
Remember that your mother has also had other benefits of the policy, notably cover for while she was actually driving it. |

Emasculated Britain is dead right, I'm afraid. There are two things here. First of all you pay a premium at the outset of the year to buy yourself 12 months cover. You can do this outright, buy the cover with cash at the outset.
Secondly, you can also effectively borrow the money from the insurance company to make the payment and get the insurance, and then repay that loan over the year. It's the same as if you took a bank loan for the premium, paid it and then repaid the bank over 12 months.
When the insurance ceases on write-off two things happen. They deduct the excess before calculating the payout. They also calculate the amount outstanding on the loan and deduct that too in order to clear your liabilities with them. |

i would not have claimed for 500 pound car to start with... when you have 100 pound excess... yeah its legal to take the years premium...but you will still have 11 months insurance left which can be transferred to another car when she gets one... or you can cancel the 11 months to get refund which will have a fee taken out... not worth it... if you need really a car Just buy a cheap one and finish the year off... your insurance premium will be higher next year because you made a claim... i know it stinks.. car insurance is really to protect the other people if you have a accident... |

I'm afraid it probably will be. I pay my insurance up front, so if I wrote off my car after paying for a whole year's insurance, they're not exactly going to be rushing out to refund me what I paid. |

Well, you bought insurance for it for a year, the car getting smashed is another matter.
But you should now be able to get another car and have your insurance transferred to the new car without paying.
Also you might get some money off the MIB they have a fund that pays off people hit by uninsured motorists. |

i have cancelled my insurance before a year was up twice while paying direct debit once they slapped my wrists and the other i was penalised with a 1 extra months payment so on that note i would try and find it in the small print as they are all different.
if it is legal then its certainly unfair especially if you have had the insurance over a year worth going into further |

Hi, Im not too sure if i understood u properly but from what i can gather you had the policy for a month, and your car got written off. You expect to get the £400 for the car as the took £100 excess, but instead they took the remaining amount of the insurance of as well.
Well if that's the case then it isn't legal (or it isn't right not too sure about the legalities). The insurance company shouldnt take the amount for the remaining contract, as the policy has ended becuase the car has been written of.
They should credit you back for the remaining length of the contract. |
