My problem is that I had a car accident last monday, and I just picked the police report. I called the other person insurance (Which is responsible for the accident), and they told me that his policy is suspended because he didn't pay. Basically he was driving without insure.
***My question is what I need to do now???
I have a repair estimate, which is $1,400.

CALL your insurance company. If you have underinsured/uninsured motorist coverage, THIS is exactly what that coverage is for.
Then sue the guy personally for any balance that your insurance company can't cover.
If you dont, then sue the guy directly in small claims court. |

First you need to contact your insurance company and file a claim. If you have the appropriate coverage (collision) they can repair your vehicle right away. If the only coverage that you have is Uninsured Motorist Property Damage Liability (this coverage is only available in certain states) then you will have to wait for the repairs to be completed, since your insurance company needs to confirm that this person is really uninsured. Also remember that your insurance company needs to investigate the accident to determine liability. If you are found to be liable then your carrier will not pursue for damages on your behalf, and if you do not carry collision coverage then they will most likely be unable to pay under uninsured motorist property damage. If you are found to be not liable and your carrier paid for your damages (under collision or uninsured motorist) they usually send subrogation paperwork to the third party carrier (or the other person if they are uninsured) so that they can recuperate the damages that they paid and your deductible amount. The first step to resolving this issue is contacting your insurance provider. They should be able to provide you with more information about the process. Most companies have an 800 number that's open 24 hours. |

You will have to go through your insurance company under your uninsured motorist coverage (assuming that you have it). Your insurance company will then go after the other guy to recover their money. |

This only means his insurance won't pay him back when he pays for your damage. So call the other person, tell them your losses are $1,400, and get it from him. He owes you regardless of his insurance or lack thereof. |
