my dad was teaching me in his car and i have a provisional license and my dad has a full license. a guy came out of a give way road and hit me on the side. the car is insured in my dads name. is this a problem and what should i do. i am really mad because it wasnt even my ault.

Basically you should be okay. You will be on the insurance as a named driver and driving with the owners permission. As long as you had a qualified driver with you, you are okay |

As long as you were on your dads insurance there shouldn't be any problem, if you weren't then your looking at your licence being taken away before you get it. |

If your dad's policy allows hime to let PROVISIONAL holders drive...you and he are OK.
If it for 'FULL UK LICENCE HOLDERS' you are BOTH screwed.
You for driving without insurance - and him for willfully giving his car to an uninsured driver. 'Not knowing' is not an excuse - they can just refuse to pay out - and you will be liable for ALL repairs / legal bills.
IF it all goes horribly wrong - it's normally 6 points and a fine for driving without insurance. ie. You've technically lose your license the instant you get it...cross that bridge if you get to it though. |

If you are on your dad's insurance you have nothing to worry about, but if you aren't not only will you have to pay for the damage because the accident will then be your fault because you shouldn't have been driving your dad's car, you and your dad also risk losing losing your licence. |

As long as you are mentioned as a 'named driver' and you've taken the other drivers details, the claim should go a head as normal.
Surely your dad knows what to do ..... he needs to contact the insurance company and ask for a claim form. Together you'll need to fill it in and as you (the insurance Co) will be claiming against the other party, it will not affect any future insurance you or your dad will need to take out. |

As long as your dad told his insurance company to add you on his insurance, then no problem. Did you get the other drivers details? Such as Name, Address & Insurance details. If so your Dad can contact his insurance with the details and they will take care of the claim against the other driver, as long as it was his fault of course.
If you are not insured to drive your Dads car, you are in trouble. |

you really should have called the police out as a witness to the damage and situ of the cars.
yes i know nowadays they do not attend damage only RTC,s(they are now called Road Traffic Collisions,in order to apportion blame)no such thing as a road traffic accident now but if you insist there is a danger of a breach of peace they will attend,namely there is about be a fight ,,the significance of that is that you can sue the other driver for damages in the small claims court for damages under £5,000 and then could call the police officer as a witness |

get dad to deal with this with his insurance CO. have you a witness that could confirm things? Or will the other driver accept 100% liability? You could get 100% cover and compensation and no loss of no claims etc,,, |

Most insurance companies do not make you add a driver until they become licenesed. You are covered by the policy as you are a member of the household. Even if you weren't on the policy this does not excuse the fact that the other driver is at fault.
There should be no problem here. You have a permit and your dad was in the car with you. The other insurance company should take care of your damages.
