Car insurance wont pay up!?

Right dilema. was involved in car accident, i tried to avoid a child who was playing chicken in the road, i hit this child and collided into a wall, my car is now a complete write off! Churchill wont pay up, stating there is no one to claim off! To top it all off i now have to pay the recovery team who took my car to storage plus storage costs! a 5k car done with,churchill wont even reimburse me my insurance as i pay annually, still have 6 month left, and not got a courtesy car either!

Hi Tracy,
Sounds like you have Third Party Fire & Theft cover. What this means is that they will pay damge you cause to Third Party (i.e. in this case, if the child was hurt they would pay damages to the child, and they would pay for the wall repair that you hit) but they will not cover any damage to your car.

What type of cover do you have? If its only third party, fire and theft, they won't pay out. My car was vandalised and my insurance company paid out, even though there was no one to claim against. I have fully comp with protected no claims. I was even given a car while mine was being repaired. I would change companies and the type of policy you have.

i thought that was what car insurance was for when you have accidents??? it depends what type of cover you have, if its fully comp and theyre not paying you can do something about it, if you were only third party or third party fire and theft it says you have to meet the costs yourself in your policy notes , and there is nothing you can do really.

If fully comp. i think you are being given the run round. Follow the Churchill complaints procedure and if they still won't pay, I would contact a press complaints man who may be able to help. If that fails he Insurance Ombudsman, After th epress not before it

was your policy comprehensive as it sounds like your on third party?

if you were on third party fire and theft they wont pay out as the policy would only cover damages you cause to third parties unless someone hityou and in that case you claim off their insuance

but if you are comp then they have to pay out! they would only give you a car if you took that out with the policy and its normally an additional charge . check you policy documents as to what level of cover you took and if you added the car to the policy if you havr then call them back to get what you paid for!

I'm afraid that's what you get if you don't have comprehensive insurance - you're out on your own unless your insurers can claim off someone else, which they clearly can't do in this case.

I think Dory is right. If you don't have comprehensive cover then the company won't pay. If you need to recover the money then you would need to pursue the person causing the accident. To do this you are going to need legal help, with no guarantee of success.

As J.G. says, you've probably only got third party insurance i.e. you pay your own costs and the insurance only pay the damage of other parties - The owner of the wall in this case.

Whilst Third party cover looks nice and cheap it just ain't worth considering as there are so many instances where this type of situation could occur.

Why should Churchill reimburse you? you pay your car insurance to protect other peoples property so of course they won't give you your money back. If you are thinking of stopping the payment I wouldn't advise that either as they will be able to sue you for the money as you agreed in the first place to pay. paying by instalments is a privilege not a right.

what cover do you have on your car? if you have comprehensive, they should be paying for it unless there is something that has come to light like points on your license they hadnt been told about etc. if you were tpft cover - then your stuck im sorry. i work for an insurance brokers. sometimes, things come to light following a claim that result in insurers voiding your policy due to something you didnt declare at inception. they would usually just charge you the price difference to the premium, unless it is something that would have stopped them from insuring you if they had known about it. if you need any help, just let me know.

check your policy carefully and see if they do, if you dont understand it take it to trading standards or citizens advice.

Remember if its in the policy then they do not have to pay up thats why they tell us to check the policy carfully.

If you don't carry collision coverage on your veh, your are unfortunately out of luck. Sounds like you have liability only.

Better Business Burue (sp? sorry) could also look in it how this insurance company is working.

You -can- sue them and also sue them to pay the court costs. You can also tack on pain and suffering for aggravation and all that jazz.

I think if I was you I would lay this at the door of the Citizens' Advice Bureau an/or Trading Standards

You hit a child and then a wall.

Of course they won't pay up, it was all your fault.

Had you been hit by another car first, before hitting the child and the wall, they would pay you.

Be more careful in future

my car was parked in my drive..next door had a wagon delivery they smashed into my car the builder got the wagon drivers details but him and his company wont admit liability and wont report to their insurance company what can I do about this.
