First, uninsured motorist coverage does not cover damage to your vehicle, it only covers your out of pocket expenses incurred from treatment received for injuries you sustained. Some states offer a coverage called UMPD unisured motorist property damage coverage. Do you carry collision coverage? If so, file with your carrier and pay your deductible. Once your insurance company has paid out on your behalf they will have subrogation rights, or the right to collect back your deductible and the damages they paid out on your claim. They will basically become your collection agency. If they recover from the at fault party you will get your deductible back, be advised this could take some time if you get anything back at all. Additionally your carrier can notify the state you live in and have that persons drivers license suspended. The same will be true if you have UMPD coverage. If you do not carry any coverage for your vehicle, then your insurance company cannot help you. You would have to file a claim against the at fault party in small claims court and get a judgement against them for your damages. When you choose not to carry collision coverage you are considered self-insured for your vehicle. Keep in mind when you purchase insurance that you are not only protecting yourself if YOU hit someone, you also need to be protecting yourself if SOMEONE hits you. Keep in mind that 1 out of 4 people driving on the road are driving unisured. This number is sure to increase as gas and food prices increase and people have to make hard choices, do I pay the insurance bill today or do I put gas in the car and go to work.

One, make sure you take uninsured motorist from now on. Trust me, it makes a difference. You always want to make sure you are covered because a lot of people aren't, regardless of how illegal it is.

Two, you can sue her for damages and such, plus legal fees. Since she provided false insurance, make sure the cops are informed and add that into the suit. See if your insurance company will back you up with the information on her lack of insurance as it will be a qualifying witness.

Have you notified your insurance company? In the USA uninsured insurance is only for bodily injury anyway. If you have collision insurance, your insurance will pay to fix your car and then go after the other party. Contact them because you may have coverage and don't know it.

press charges and SUE SUE SUE, you probly dont even need a lawyer for it. sounds pretty open and close. garnish the ladies wages have any taxable property she owns collected and auctioned untill it is paid off. lawyers are good help though. OR you can do it like the illegals like to do it when someone owes them money... well your a family man never mind
