I was involved in a car accident about 6months ago. I hurt my neck and back but didn't go to the doctors/hospital to have it checked out due to shock and pain occuring after 48 hours. Would I have a strong case if i was to claim compensation?

No--you waited too long. You ALWAYS need to go to a doctor/hospital/chiropractor after an accident - whether you feel pain or not. Whiplash can take at least 48 hours to show symptoms-sometimes longer! |

You may be able to pursue the insurance company, however since you haven't made a good faith effort to date to rectify this situation your claim would be minimal. I've been through your very same situation, your best advised to speak with an attorney and discuss your legal actions. They can have a professional medical examination that will help you determine the best course of action to bet yourself on the road to recovery.
Personally, I'd recommend seeing a chiropractor.

well a friend of mine is a lawyer and this happen to me not to long ago and depending on the state you live in it ranges in time. In Louisiana its a 1 year grace period after a wreck to claim any thing else. hope this helps and good luck! |

You claim to have pain, but didn't bother to seek treatment at the time? What do you think the insurance company lawyers would do with that piece of information? Even after 48 hours you still didn't go, and you waited 6 months to mention it? Forget it. |

No. No treatment, no claim. And if you start going now the insurance company won't buy that it could still be giving you problems six months later. The shock of the accident doesn't last that long, and symptoms show themselves within a day or so. If they really want to get rid of the claim, they'll maybe toss you a couple hundred dollars, but they don't have to. |

Possibly but you would have to go for a medical now, if you still have any symptoms you have a better chance. You have up to 3 yrs to claim but without ANY evidence, it would be tough.
Try speaking to one of those 'no win no fee' places, even if you don't use them, they will give you an idea of your chances. |

Very Doubtful. The other parties insurance Company will want to see the doctors reports and any hospital/x-ray evidence. If you didnt even go to the doctors, they will say you were fine then!
ALWAYS go to the docs after a car bump! It may pay off later. |

No, you are out of luck.
Others are right in that you do have 2-3 years to get a lawyer and file a claim against the other person, BUT... you need to have filled out papers from your insurance company first telling them you want to claim whiplash. Did you end up going to a doctor at all in the first few weeks after the accident? Did you get any treatment from a physiotherapist or chiropractor?
In Canada, you have 7 days (from the accident date) to report any injuries to your insurance company, and then they will send you some injury claim forms, and you will have 30 days to submit those forms to get any money or compensation for treatment. Check your insurance but there are usually similar time limits for these in other states.
If you didn't submit any forms to your insurance about this matter then you are probably out of luck. A lawyer will NOT be able to help you without those papers (I called a few lawyers after my accident and that's what they told me). |
