Ok, so here it is. A guy hit me, police report said his fault. Totaled my truck and I got a huge amount of med bills. Now I know his insurance co. is payin for my truck and my med bills, but can I also claim on my insurance for pain and suffering, etc?

Ok yeah I have an added on underinsured motorist policy with 50k coverage, im gonna ask about that.

It is possible...depend on the Insurance carrier/company and if you selected the right type OPTIONAL features to add to your insurance policy...(If you just didn't go with state legal minimum coverage and acutally went through your policy or sat down with your insurance guy for the options....which would have increase your premium.)
If you went with cheapest possible rate you would have basic coverage and possibly compr/coll if you drive a newer car....Most insurance agent will quote you cheapest "base" rate....that is until you ask for more coverage because you have more asset...
Check your policy to see if you might have added the optional insurance coverage.... |

Contact the adjuster who is handling your claim. Find out if you are tort eligible. The threshold requirements vary from state to state. Some states are verbal, some are monetary and in other's your injury must be serious. The definition of serious varies.
If his policy limits are inadequate, you can file an Underinsured motorist claim against your own policy. In most states however, the amount you collect from the tortfeasor is deducted from your limits. That is, you have $50k in underinsured coverage. You collect $25k from the at fault party. The most you can collect under your policy is $25k. Also, depending on what state this loss occurred, you may be able to stack other household policies for additional coverage. |

No, you only get money on his insurance policy. You need to keep at your ins company to get more out of them. They can settle the car first, and then settle the insurance for injury later so you can continue treatment though, to get more money. Get good advice from your insurance carrier about this, it is their job to get for you all they can. |
