hi i parked my car 2 minuits away from my garage and the police came and it had no tax mot and i had no licence or insurance and thau towed my car and the police woman knocked on someons door and asked if the saw me drive it and thay said yes. she said i whould be going to court but its now been 8 weeks and i havent heard a thing??? what do u think will hapen may there be a chance that im not going to court ?????? please help

You will probably be prosecuted for no keeping a car on a road with no Excise licence/MOT and insurance.
You will not be prosecuted for any driving offences as, unless it's following a road traffic accident, driving licence offences have to be 'found committing' ie, a police officer has to witness you driving.
Contrary to other contributors submissions, none of the offences you have committed require a NIP.
Unless what the neighbour said was in your presence and hearing, what she said was hearsay and inadmissible as evidence. |

Its not good news, if at the time they said the magic words of, "im going to report you for consideration of prosecuting you for the offence off...."
Then the NIP has been served verbally, and they have up to 6 months to deal with it. But if they haven't said anything, and you haven't got a NIP in the post around 14days after the visit, then i wouldn't worry too much (easier said then done) as they haven't followed due process.
best thing to do is to speak to a solicitor, the first 30mins or so is normally a small fixed price to hear your storey, they will then advise you where you stand, to put you mind at rest.
Also try this site, www.pepipoo.com i don't suggest or condone getting off just for the sake of it, but its worth a look, perhaps the lads didn't know what they were doing and didn't follow the guidelines.
but really you shouldn't have driving the car, if you did that is, for the obvious reasons.

You will get a summons, also called a subpoena, in due course. Make absolutely certain that you show up on the date and at the time appointed. Do not be late. Judges do not take very kindly to tardiness. |

could be they just sold the car but there is a better chance that the court is just slow this time of year, do you know that there is a charge for every day that your car is in the impound lot oh and by the way what the woman said is not heresay if they bring her into court to testify, and what are you doing on the road with no license and insurance you know that you were wrong and that is why you parked your car 2 minutes away from your garage, hope they get you it is people like you that make all of our insurance rates go up and think that you are above law and that you don't have to follow it like the rest of us |

They do not need evidence that you drove the car. It is an offence to leave an untaxed, uninsured vehicle on the public highway.
One assumes that, first off, you will be given the opportunity to pay a fixed fine. Next, if you disregard that, you will find yourself with a much heavier penalty, awarded by the courts.
In any event, your pride and joy is probably a small rectangular lump already! |

No tax, not MoT, no insurance & no licence? You will be hearing, my friend, I'm afraid. And the neighbour's testimony is NOT hearsay, she can give a statement and give evidence in court of what she's seen.
It could well be some time yet until the court can fit you in, but fit you in they will, I suspect.
When the summons comes. you will need a lawyer if only to mitigate for you. |

they have 6 months I believe to give you your summons, if you get past 6 months your off the hook
btw get a good solicitor and deny the whole thing, thats your only chance

if its been 8 weeks chances are you womt here anything if you havent heard anything in 6 months then you defo wont hear anything. iv been court driving without a licence or insurance about 3 or 4 times and iv never been sent anything and have never been to court. |

unless they lost your info (wouldn't that be great luck!), then yes, eventually they'll get around to you. a good way to find out if there are any current charges against you is to call the police dept posing as another person & "inquire" how you might find out if there are charges against someone you're close to so you need to know. (I've done that for other ppl.) Legally, it would be considered public records so they have to tell you. |

first tell the judge that the cop didn't see you driving,
then just prove you had a valid license, and registration at the time,
you'll probably get a fine, if you know what it will be(try making some calls to the court and see if they know), send the money to the courts and you may not have to go.
I got arrested for having a suspended license, in new york they put you in jail for driving illegally.
and get your car out of tow, fast! it costs more and more money every day you leave it in there.

if the car was parked illegally, there is no way to prove who was driving it unless they police pulled you over. Anything that women said is considered hearsay, and not vaild in court. So the only thing is you might get a parking ticket and a ticket for having a non registered car parked on the road.. you will not get in trouble for for actually driving it unless you were pulled over. You will only have to pay the towing, impound fees, and tickets. Now, if the car was parked on private property, they cant tow it unless the owner of that property had it towed. |

i don't think they can take u 2 court if the officer didn't see u driving it herself. I went to court for something more serious and it was longer than that till i got my supena. u may not have to go to court , they may have been bluffing or trying to scare u. if u go to court, good luck. |

You should have definitely gotten something in the mail. Be careful because if you miss your court date you may end up with bigger fines and more community service. You can go online and find out what the laws are in your county for driving illegally and you'll be able to figure out what you're getting yourself into. I would call and find out what's going on for sure. My brother in law had to pay thousands of dollars and do community service because he got caught driving without a license. It seems like they're harder on people who drive illegally than they are on people who get DUI's, that's the case where I live anyway! Good luck! |

In the UK for most offences they have to officially inform you (eg by letter) within 14 days of the offence that you may be charged. If they don't do this they can't proceed, though they may try. It seems that unfortunately you have got away with it. |
