Courtesy car insurance - who is responsible - driver or garage (UK)?

My missus just had a prang in a courtesy car.

The garage gave her the car, didnt ask her if she had insurance or anything.

Our insurance company say they would have covered us if the car had been 1.7l or lower - its a 1.8.

Who was responsible for ensuring that we were insured - us or the garage? Where can I go to find out about this?

Anyone have any idea?!

The garage owns the vehicle therefore it is their responsibility to ensure THEIR vehicle is insured to be on the road. Unless they have a signed contract transferring this responsibility to you the garage wouldn't have a case in court.

Normally the garage. If they dont provide insurance they have a duty of care not to let you drive the car until you provide proof of insurance, which would mean they'd have told you and you would have needed to provided a cover note.

Unless its a really dodgy garage . . .

However, in any instance it is the drivers responsibility to ensure the vehicle is legal and roadworthy at all times so, although the responsibility is shared to a certain degree, your missus should have confirmed the vehicle was insured prior to driving it.

I'd contact the Citizens advice bureau for further advice.

YOU (ie the driver) are responsible for ensuring insurance is in place. Normally the supplier of the car would arrange the legally required third party bit but the comprehensive would be down to you or your existing insurer. It always pays to ask for all the insurance details BEFORE taking a car.

Every time I've had courtesy cars whilst I've had vehicles in for service or repair, insurance has been down to me. There's usually a waiver to sign or just a copy of terms on the wall of the garage.
The only 100% guaranteed way of confirming is to ask the garage, but I'd stake my house on it being your responsibility.
