Bostonian is right. It'll take months if not years to sue the person. Have YOUR insurance pay for the damages and let them try to recover it from the drunk driver. |

Definitely! In this case, she needs to pay the price and realize that she is a danger to society. She needs to be held accountable for the money she owes you also, even if she never pays. If you get her to learn the lesson now, you may be saving a life. If she hires a lawyer to get her off for some basic charges then who knows, next time it won't just be a money issue, it will be someone's life...Go all the way, get her put in rehab or the most you can possibly do! |

I don't know what the record is on suing uninsured drivers, but I feel you on this one. Do you know if she got a DUI at all? Was there a police report filed? I would check with a lawyer just to see what sort of case there is. The problem is that she's probably got no assets, in which case no lawyer will represent you. BUT, maybe you could sue her in small claims court and get a judgement for a portion of the money.

Does she have any assets that would make it worthwhile to sue? If not you will be out more money for attorney fees and just have a piece of paper that won't do you much good. |

You can try, but chances are you won't collect on the judgement. If she's being prosecuted for drunk driving be sure you ask the D.A. about restitution--you'll need to provide proof of your damages. |

alotta people die in drunk driving. i mean maybe if u sue.. she'll learn her lession......but the thing on the down side.. could be she retatliates in violate manners possibily vandalism to ur home since she knows where u live?? does she lol |

I agree that this person should be held accountable!
The downside of suing people is that the courts do not enforce payment when you win. You have to go through other processes in an attempt to ensure payment. |

Just get her insurance company to settle with you. They will pay you for the damages caused by this accident. Don't get a lawyer unless you are injured. Most likely not atty would take your case w/o an injury claim. If she doesn't have insurance, then take her to court to try and reclaim your damages if she even has any assets. |

I am not a fan of needless law suit but from what you have said sue way just remember civil court can't be asking for over $5,000 good luck and your so in the right to sue her |
