I was harm badly in a car accident.
That day was my girlfriend birthday party. We invited lot of peoples. After we ate we went to bowling together. After that we would go back to the eating place so someone can pick me up. So me, my girlfriend and my other friend went to her friend's car. I don't know her friend, it was a guy who act kinda tough. He was driving crazy and fast, he cut the opposite line and went fast ahead. I think he was trying to show off or something. I want to tell him to slow down but i don't know him so I keep it to my self. Then he hit a van and crash. I think at the time my head hit something so I passed out. After I woke up I was in the hospital full of pain. From what the doctor and my girlfriend told me, the car crash and flipped, it fell down to a river. Even the helicopter came help. My skull was harmed and I have internal brain bleeding. My nose is broken. My Jawbone was badly broken too. both of my arms, my neck and back bone is hurt too. I cant rise one of my arm and straight my other arm. At that time I was passed out and bleeding badly. I had surgery on my nose and jawbone. and I just got out of the hospital this week but still my face and lip is swollen big.
My girlfriend is ok. But her arm break and her eye was bleeding and swelling. Good that I was there if not she gonna be worst. Well, I'm the worst in the whole accident and the only one who needs surgery.
I just wanted to know about claims. Because my brand new $300+ cellphone was broken, my $100+ jeans are cut by the doctor. My lucky couple earring was stolen. That's not it. The the worst thing is I will be in pain and emotional stress for a very long time. I hit my brain and it was very dangerous. I could almost die, lose my memories or become mentally retarded. The doctor told me I will need 3 month to fully heal my scars, surgery and swollen.
From what I know is that the guy has insurance on that car he drove. But The lawyer said still need to wait for the police report. What should I do next? Or what should I said? I'm still in the early process of healing my pain. And I am very pissed at that guy who caused all of this. If he didn't drive crazy we won't be like this. I can't even take the final in school and I might have to retake my grade level again!

it is not clear if you have an attorney or if the other guy does.
if you have an attorney, it is his job to handle; the police report is just a formality that verifies time, place, driver and passengers involved. it can take a few days to few weeks depending on where you live.
it appears there were quite a few serious injuries, with yours the worst.
have you contacted your insurance company (or your parents since you appear to be a minor)? they need to get involved and they maybe able to help with the medical bills if coverage on policy.
depending on where you live and the state laws, if this guy has minimum coverage on his auto, there maybe not enough to pay everyone for this accident; if you or your parents have underinsurance, it could pick up for the excess;
as for the cellphone and jeans and earring; this would fall under the property coverage; they wont dispute the jeans, since expected to treat you, but the earring maybe difficult to prove stolen--could have fallen on ground, in car while in transport and the cellphone also; but that is what the insurance company will decide.
if you think that you will be paid and settled in a couple of months, dont cant on it. you are still treating and will be for awhile; my guess would be a minimum of 6 months to a year before any offer of a injury settlement.
your lawyer if you have one can explain the process and what laws govern in your state and what options you have.

This accident you described is way out of this Q&A league. Your attorney is the best person to be asking any questions, if you are in the US and you are questioning your attorney's methods, then you need to contact the BAR Association and have a advocate look into your case and asses how your attorney is handling your case. And it does take time, My sister was in a accident kind of like yours, and her attorney still took about 6-9 months to close the case but he did a good job. It does take time all the legal mubo jumbo and the legal hoops to jump. It definitely not a overnight process |

What you need to do is to get a personal injury attorney to help you with your claim against the insurance company. You can get a free consultation with one. You can sue the guy, and the insurance company for pain and suffering, plus any and all medical bills that you will have from your accident. However, most people have a maximum that their insurance company will pay out, so you could still end up with some of the doctor and hospital bills unpaid. I wish you the best. The attorney will get any and all reports from the police concerning your accident. You will need to be careful because his insurance company will try to get you to settle out of court, and sometimes that isn't the best thing for the injured party. |

tragic story. let your lawyer handle this. make sure that everything is documented. all your injuries listed, the treatment required, the long term prognosis, EVERTHING!!! do not speak to outsiders about your case-that includes, sadly, classmates and friends. someone could repeat the wrong thing and ruin your case.Hope you recover soon, and keep up the good fight! |

Sounds as if you already have a lawyer ? (" But The lawyer said still need to wait for the police report") If you don't have one get one now ! I suggest you and your girlfriend hire the same attorney. It will simplify things and be better for the both of you. |
