Denied insurance claim?

i was recently involved in an auto accident, was at the intersection waiting to make a left. the light went yellow and still waited a sec or so and began to turn. the other driver tried to beat the light and totaled my car. even though i have the police report which says shes at fault, and on the report she claims she doesn't remember what color the light was which means she wasn't paying attention. there's also a camera on the street to prove my case, yet her insurance still denied it and said I'm at fault because she said so. i was shocked because she has all state and i thought they would handle this a little more professional, and the adjuster i talked to was being extremely rude, i know i have a solid case but my lawyer told me he needs 2 to 3 months, why would they deny it like that?

Lots of times they will deny a case just to buy some time. They hope that you wont pursue it any further. You just have to be very persistant and make sure that your lawyer gets on it. if he doesn't perhaps you should look into getting a new lawyer. Find out if there are any lawyers that will take your case sooner. if they do then go back to your lawyer and tell him if he doesn't do anything about it now, your getting different legal representation.

Actually since you were turning left in front of an oncoming car, and both of you were going through the yellow light I'd say that she is right.
You would be at fault for turning when it wasn't clear.

If you're making a left hand turn, you have to yield to all oncoming traffic. It sounds like you failed to yield. When making a left turn, the only time you have the right-of-way is if you have a green left turn arrow in all other situations you have to yield.

The police do not determine fault, the insurance companies or a judge determine fault. Unless the officer happened to be at the intersection and saw what happened their opinion on who was at fault has no bearing whatsoever. The other driver is Allstate's client, not you. If Allstate's client says that it was not her fault, then that is Allstate's position. Allstate does NOT have to listen to you or entertain your arguments, unless you can provide independent (not in either vehicle) witness to back up your story. The easy way is to report the claim to your insurer and have them deal with your claim. However if you still wish to do this through the courts keep in mind it's quite possible you could be found partially or fully at fault for failure to yield. You said there was an intersection camera, but what does the photo/video of the camera show?

dont be "nice" to them, tell them the police report says your clients is at fault, i have talked to my lawyer and if you are still denying my claim i will just let the court deal with it

Just lawyer up and sue them. Usually you won't even have to go to court. They will just come running with their tail between their legs.
