Sorry its long.I was inside my car at the market and i see a cart rolling down from my rt. side view mirror and hits my car. Wham! I get out of the car and go to the guy that was right behind me because the cart came from that dir. and because there were no other cars there.I ask him if thats his cart. I think i had to ask him like 4 times and he just sits there and looks at me like he doesn't know what to say. So at this point I'm getting really frustrated because he just keeps ignoring me ready to leave.And mind you that the returning cart area was like 5 ft away from him. Then the security mngr comes and gets the cart and says he saw what happened. Then the guy finally gets out of the car and he looks at the dent and gets all mad saying how he can hit my car when he was back there. So him and his passenger just leaves. I got his plate# and the security guy said he will be my witness and to contact my insurance. What do i do? and what do i tell them b/c it wasn't like a car accident.

Tell them what happened. If you have a witness and the guy left you should be all set. You may need to fiel a police report but call your insurance first. |

well you should have called the police from the scene and had a report done. contact your insurance company and file a claim. |

This will be covered under your auto insurance under your comprehensive coverage (cause of loss - vandlism). Let them know your car was damaged by a cart while parked. It will not be a surcharable loss. You can give the insurance company his information and your witness information, and they will deside if they want to sue the other party (subrogate) the loss. If the subrogate successfully, you will get your comprehensive deductible back.
An insurance company could also classify that as a collision - as your car did collide with something. But it still would not raise your rates. The same information applies about subrogation. |

Technically, if the other guy did not physically drive the cart into your car, its not his fault. The wind could have taken the cart, it could have rolled on the uneven ground. The supermarket would be liable however I am sure they have signs posted taht they are not responsible for damage caused by unattended carts.
You can make the claim w/ you insurance if you think the damage is over your deductible. But they will not go after anyone for subrogation |
