Last year (dec 2006) i was stopd by the police for driving without insurance on a provisional liscence during a lesson with my mum (i had already contacted insurance company bt stupidly drove without official documants, which came couple of days later)
Anyway I passd my test 3months ago and was summond 2 court last month about the offence. I gt a fine and 6points on my full liscence. But the courts did not disqualify, ban or suspend my liscence, & did not force me to resit (nb: this ws my 1st offence). The courts gave my liscence bak (with the points added on2 it)
But according 2 the dvla "if you get 6pnts in 2yrs u go bak2 learner status". The dvla havnt contactd me about a revocation etc so does this mean i can legally drive?Do i need to contact them about the points,or have the law courts already resolved the matter with the dvla?
ps. i am fully comprehensively insured & hav bn a law abiding citizen to date. (btw i askd this Q'n b4 bt was hoping 4sum more responces).Cheers Additional Details thanks for all your help. I contacted the DVLA and they told me that given I committed the offence prior to passing the driving test it will not affect my entitlement to drive, so I can legally continue to drive
However they said I cannot receive any more points within the next 2 years or I will be revoked under the New Drivers Act and would then have to resit the test.

The procedure is you do re-sit your test, but the court didn't tell you anything and handed the licence back and even I would assume that I would be ok. I would contact the DVLA and police or someone similar and ask them for a direct answer and state the same what you are saying here, and get it in writing as proof if they say you won't have to. |

It seems that you may have escaped the disqualification. The rule is, you could be disqualified for 6 points or more, but the court makes the final decision.
The decision will be printed on the bottom of your paper licence part in the endorsments section. This will tell you if you have been banned.

Looks like you've been extremely lucky and the court has decided not to have your licence off you (disqualifications are within the court's discretion usually) . If you were disqualified, they would have told you at the time and held onto it (I presume you took your licence with you to court).
As you're now a law-abiding driver, I'd ring DVLA with your licence details to hand and check with them for certainty. |

It is at the discretion of the court whether or not to suspend your license.
It usually happens but count yourself lucky. |

If you drove with no insurance after passing the test then got 6 points you would have to pass both driving tests a second time.
In your case the offence was before you passed the test so will not have to re-sit both tests.
You will still have 6 points on the licence, 6 more you get a ban and have to do both learner tests.
This confusion comes from date of offence, date of conviction and test pass date.

I don't understand why you have been penalised. If you had contacted the insurance company and were awaiting their documentation, the police normally give you a producer which means they ask you to provide evidence of the insurance being in place within a week. It would have given the insurance company time to post the documentation to you, and for you to get to the police station.
I would suggest that you contact the DVLA. Its best to get it checked than to assume you are ok to drive and then be pulled by the police again only to find out that you should be resitting your test. Better to be safe than sorry! |

Yes you will have to retake both parts of the driving test again because you will revert to "learner status" once you have more than 6 points in 2 years after passing the test. |
