Do you think we'll be dropped by our insurance?

My sister was hit by a drunk driver last night (he was taken away in cuffs immediately). She was driving my husband's new car. We have reason to suspect the driver that hit our car does not have insurance (they couldn't get into the glove box for proof of insurance because of the damage). We are insured for this and we've had the same insurance company for about 10 years. This is our first claim.

We always hear stories about being dropped from insurance companies after filing a claim even if the accident wasn't your fault. Do you think this will happen and do you think we'll have trouble finding new insurance?

I'm not sure who is doing all the thumb's downing - whoever it is perhaps they would like to offer their own opinion since they seem to disagree with everyone.

If he's not insured, you will have to pay your own deductable. Then your insurance will pay the rest. Your record with them will contain a received to payout ratio. One accident is not that terrible, even though it will seem it to you. Even without insurance, your insurance may go after him for his assets if he has any.

Since it was a drunk driver & clearly not your fault & first accident it really shouldn't be a problem. You didn't mention, so I assume you didn't have more than an odd traffic ticket.

Insurance companies can be strange, but you aren't the type client they are trying to drop. Ask them point blank what their policies are. However, instead of worrying about being dropped, worry about putting this behind you. I hope your sister is physically okay. You never know. This might be the last straw that helps that other driver get himself some help.

brings up uninsured coverage. Because it's just the cost of the car, you'll have enough uninsured to cover it. The minimum covered will be usually 50K, could be a little less. So I suppose if the car is expensive & totalled & you don't have much coverage, & he has no assets, you could be out some money. Your policy will say the amounts. With uninsured motorist you will pay the deductible.

However, you should look at your policy & make sure uninsured coverage is at the same rates as regular coverage in case in the future there is a serious accident with an uninsured motorist. One way insurance companies will make their rates low is to keep this coverage lower when giving quotes. (You probably knew all that).

I'm assuming an at fault state because if it was no-fault, you'd already have said that, & your insurance company would have said it by now too.

You'll be fine :) - just ask the insurance company questions.

I seriously doubt it, especially since it was clearly not your fault. I've filed several accident claims over the years, about half of them my fault (teenage driver), and never had any difficulty with the insurance company.

The only person I have ever known who was dropped by the insurance company was my father-in-law...but he was 83 years old at the time and had Alzheimers. Honestly, the insurance company did us a favor getting him off the road.

You will not be dropped and your premium will not go up. The accident will be listed as not at fault. You will pay the deductible and the your insurance company will attempt to collect from the at fault driver. If they collect, they will reimburse the amount of deductible you paid. Even without insurance the at fault driver may have assets that can be attached.

Sorry, But you got mostly bad answers here.

Some things depend on what state your in. However, if you have uninsured motorist then your insurance will cover your car with no deductible. But you will have to wait for them to confirm that the other driver does not have insurance.

If you do not have uninsured motorist then the damage to your car will be paid under collision. With collision you do have a deductible. So, hopefully you have uninsured motorist.

Since your sister was not at fault your insurance rates will not go up and you will not be dropped.

Yikes, you won't be dropped for some idiot's task buddy, give it a break.
Why would you be dropped? You only get dropped by being a habitual offender. This wasn't your fault and there's no reason for getting any surcharge either. You're golden.

You can take that to the bank.

what you have heard from other people is wrong, insurance companies don't drop people unless they have done something really bad, seriously wrong, at fault, lied to everyone, etc so when someone tells you that they were dropped for no reason you know that they aren't telling you the truth

No, economy is tight. Business's, even insurance, cant afford losing customers and customer referrals (i was reffered by customer to my car insurance) Finding insurance no problem, especially when the accidents not your fault. No point on your record.

The drunk will probably sue you for being in his way and get your house when he wins. This is a perfect excuse for your insurance company to drop you, on the grounds that you willfully let a drunk, uninsured motorist hit your car.
