Does the insurance company have a right to the title of my car if it is totaled? They don't get the house.

If something happens to your house they don't take the remains of the house so why do they get what is left of the car? Please if you can help answer this and back it up with information that would be great.

Yes b/c the insurance essentially is buying the car from you. Refuse to turn over the title and they'll refuse to mail to the check.

You're comparing apples to oranges with this question. Your question was already answered the first time you asked. Yes, once they total and buy your car, they own it and can do as they please. If you really want it that badly, buy it back.

Get over it.

When the insurance totals your car and sends you a check, they are buying your car. They will then sell the car to a scrap yard to recoup some of the expense. If you want to keep the car, the insurance company will deduct the salvage value of the car from the insured value and give you the difference.

because the land on which the house sits is NOT damaged..they pay for the damage only...if they give you the value for the Totaled car they become the owners...if it is repaired the title is then marked as a salvage vehicle...you can in most cases buy the totaled car back from them for around 200 bucks...if not they sell it to junk yards for parts and scrap

If you do not want to retain salvage, then yes you do have to sign the title over to the insurance company. Basically what you are doing is selling your totalled vehicle to your insurance company and they are paying you fair market value for it. This way, since the insurance company now owns the junked/salvaged car, they can sell it or do whatever they please. If you DON'T want the insurance company to take the car, then you can request to retain salvage, they will deduct the salvage amount from the fair market value of your vehicle, and then you will be responsible for the junked car.

The reason you don't sign the title of the house over to the insurance company, is because you would rebuild your house, and you are not selling the house/land to the insurance company.

Depending on the state you live in depends on the laws.
Most states depending on your vehicles age the insurance company takes possession of your vehicle (and the title)
You are getting paid for the vehicle so why do you feel you would get to keep the title for something that is not yours?

If the home is completely burned to the ground, then they purchased the HOME from you and give you the lot back. It now becomes a title to the lot with no home. When you car is totaled, the insurance company purchases the car from you. They can choose to sell the car back to you at the diminished value rate if you so choose. If your home is a mobile home, then they will require the title to the home, since the home and lot titles are separate.

if ti is totaled the company can and will take your car. they will eventually pay pay for it. for what it is worth anyway. sorry about your car and good luck.
