I realized how much mileage I put on my car last year for company use during company time and decided I would not use my car anymore. I asked for a company vehicle for my department. My employer adv me if I choose not too use my own car I could be fired. In my job description it doesn't state I HAVE to own a vehicle nor provide one for my duties or required to drive anywhere.
Can they terminate me for this?

Your job description isn't really relevant since you've been using your car for a year, you obviously have agreed to do so regardless.
Did you know when you took the job that you'd have to drive around a lot? Did they promise you a car when you hired on?
Sorry, you know what the job requires, of course they can terminate you if you refuse.
Now, if you are a member of a collective bargaining unit, then the union contract will determine the outcome. |

Not that this may be any comfort to you But; Did you know that If you use your car for your job you can take what I believe now is $0.45 cents a mile off on your Federal taxes? Way back when I first started with the DMV in my State. I didn't have an official vehicle given to me for a 90 day period. I was given a Federal form (I Don't readily know the form Number) On It is a mileage calculator that you hold till its Income tax day. But I'm sure that your boss can terminate you for refusing to honor the companies policy on using your own car. What arraignments did they make for the wear & tear of the vehicle? In many states, you can be terminated for no reason at all, so your employer may be within their rights. Most decent companies that require you to use your personal vehicle also reimburse you some amount for that mileage. If your company requires you to use your personal vehicle and refuses to reimburse you for that use, then it sounds like a crappy place to work. |
