I was driving my moms car, and i was at a stop sign, and a guy made a very narrow turn and then when he saw me he stopped, after he started going, he then made the turn , but ended up hitting the back left side of my bumper, nothing major, only some scratches on the paint, i got out with my mom and we exchanged information, but he said that he will not pay a cent for it, and he is ready to call the cops and file a report, i thought about it considering that i only have a permit and the car is under my moms insurance, and i just let it go as i may he may have made an excuse cause i am 16 and i am still training with my parent next to me.
if i called the insurance company to get it fixed, will i be blamed and will i get the insurance rate to increase or he would have been the one to blame?

and by the way, he kept saying that the car wasnt fully on my lane, as the road was narrow and 2 way, and he kept saying that you will call and both our insurance rates will go up so i am afraid that he may lie about my car having its tail a bit out thats why it hit.
does that make big of a difference although we both know that i wasnt responsible for the hit?

You guys should have called the cops when it happened. Simply exchanging information these days are NOT enough because not it becomes and issue of he-said she/said.
You wont be responsible, its your MOM's insurance company that will need to take care of it.
And the guy is bluffing. He would have called the cops when it happeend. He's just trying to scare you. |

Didn't you just ask this?
You file a police report and file the claim with your insurance. Sounds like he's at fault, which means he has to pay, and your insurance will make him pay. |

You were stopped at the stop sign when the other driver hit you?? then he would be at fault. You need to contact the insurance company and file a claim. If you do not have his information then contact your own and they will do their own investigation and determine who is negligent. Don't let someone take advantage of you just because of your age.

You screwed up. He is not the one that determines if you were or if you were not in the proper lane. The cops determine that. You should have called them. Simply turn this in to your own insurance company and let them go after the guy. But..... If you use your own collision insurance to pay for repairs, you will have to first pay any collision deductible you may have and yes, your rates may go up. |
