It hurts when you follow all the rules and someone else doesn't and you get the shaft. I don't know what state your in but in Ca you can use the law to help you (in a round about way). Ca has a requirement for car insurance, yeah, they get a fine, maybe, what do you get, a headache. Sometimes, pending the amount of damage the insurance co will go after them and put a civil judgment against them (not always). Turn in an accident report!!! In Ca DMV don't know without an accident report. Not a police report; a DMV accident report. With your report DMV will suspend their driving privilege and require 4 years of an SR22 insurance filing. Hit them where it hurts, in Ca it doesn't go away years down the line when they're trying to be good, it'll catch up. Tickets and judgments go away in 4-7, DMV is still there.

your lucky ten years ago I got into someones car and he rolled it and had no insurance I'm disabled for life. he ran from the law ans is a fugititive. she has to have an active insurance policy if its old

It sounds like she gave the police some type of proof of insurance. I would call them and tell the officer who did the report she gave false information to you and them. I hope the driver gets a ticket she should have insurance and must pay for not having any. If she faces no consequences she might do it again and again. She will not get her car impounded in most states on her first offense especially if she gave the officer proof of insurance.. Your insurance company will take car of the damages for you. I hope this does not make your insurance premiums go up in the long run.

You are covered by your insurance. You said so your self. SO GET OVER IT!!!! Why are you going to go after her??? If she can't pay her insurance bill how do you think she can pay you some judgment.

Pay your deductible and be happy you bought insurance and followed the law.

Try asking your insurance company. I would think that a civil suit against the other driver would be your only recourse. The police typically won't impound your car for no insurance - they'd cite you and possibly suspend your license. The insurance company can't FORCE her to buy their insurance. So, your last resort is to go after the money via civil lawsuit or small claims court, depending on the amount of the damaged.

But the thing is, since you have uninsured motorist insurance, just let them deal with it. If you want to go after her for the deductable, you can, but it may not do any good. Even if she's found against, it's notoriously difficult to collect settlements on small claims findings. She can just continue to blow it off.

Chill out, your insurance will cover the damages, thats why you pay them. They will then in turn go after her company, and then her. Just relax, your part is done.

Not sure what part of the country you are in as policies and laws vary.
You may have Underinsured Motorist Coverage, or UIM coverage, if your UM limits are greater than the minimum limits required by law ($25,000 per person, $50,000 per accident). Had the same thing happen to me about a year ago. The kicker in my case was that the lady driving the other car not only didn't have insurance but she didnt have a drivers liscence. The cops did not impound her car they just found one of her relatives with a valid liscence to drive it home. Usually on a first offense they wont impound the car. It was my personal experience that beings she couldn't afford to insure her car there was a good chance that she wouldn't be able to pay and suit that I would have been granted so it wasn't worth the atty's fees to even try to go after her. Your best bet is going to be to let the insurance companies fight it out, that way any court fees come out of their pocket and not yours.
