ok, so i was at my fault and we exchange all our information. when i looked at his, neither his insurance or registration was up to date but he assured me it was, well insurance wise. We waited for the police for an hour and couldn't wait any longer so we decided to just call each other. His mother calls and pushes me to do it outside of the insurance. I'm only 18 and my parents don't know much about this stuff since they don't speak English. so i agreed not knowing what to do. Well they got an estimate and it's about 2000 dollars, me or my parents cant afford that and I'm really regetting not taking it on insurance. i am wondering if its too late to file the accident because of the DMV 10 days thing. can someone please give me better advice?

i was trying to make a left turn and only saw the car in the furthest right hand lane and did not see the car behind it. i was pretty far out and he didnt notice me in time to brake so he hit my driver's side back door. Only his front bumper was damaged from what i saw. And my door just has a big dent in it. I honestly dont know why his mother is handling this business matter, he doesn't want to seem to talk to me much and let's his mother deal with it.
this is my first accident so i'm unsure of what i am suppose to do and what not to do. It took them awhile to get back to me, less than a week after the accident the mother called me to make sure i was agreeing to take it outside and told me she was going to have her son get an estimate. It took her 2 weeks to get back to me when she told me she was going to get back to me within 3 days.
Should i ask her personally if i was to pay out of pocket, would i make out the check to her personally or made to the auto shop?

California state law requires that you report accidents immediately for this very reason. You can still try, however I don't know if it will do any good. If you had, you would have had the police to take photographs, etc. |

sorry for that but in next time never admit fault even if you where and NEVER not turn it in if they ask you not to 9 times out of 10 there not insured live and learn |

You either pay for the damage or get your insurance to pay. There is not much else the other driver can do when those are your only options.
Why would the other person not want to go thru insurance? If it was your fault, it's not a knock on them. That's suspicious.... |

You can still contact your insurance company. Just tell them that you were going to settle between yourselves but decided against it. They should pay. |

You will have to call them to see what your options are. you had to wait an hr for police? that's a real long time to wait, but since you did not, you do not have a accident report. I am thinking you are going to have to pay for the damage. maybe they would be willing to take payments from you. good luck. |

I would call the PD and see if I could still file a report. Depending on your insurance company you may or may not need one to file a claim. If the accident was your fault they (insurance co) should pay for the cost of your car, and the other car to be fixed. You would pay the deductible. It's unusual that the other party would not want the incident reported seeing as they where not at fault.

I would go to your local legal aid society and seek help on this one ... I bet all his stuff was expired and it would put a lot of the blame on the other party..... |

i would say just pay for it because if it was your fault, you might end up haveing to pay the other guy and still have to fix your car on your own. |

I live in Michigan and we are suppost to report accidents, if we dont report it and some how the police find out, we get an automatic fine and 2 points on each licence of the drivers involved. MANY times accidents are not reported to avoid tickets and fines.
I would be lost in this situation too. Technically since your at fault, its a good thing that it wasnt reported to the police (you would have had fines and points, thus your insurance would go up for the next few years).
Tell the other party to tell their insurance company that it was a hit and run, thus part of the comp part of a claim.
Technically since NO police report was filed, I dont think you are responsible for anything. Its been over 20 days.
I personally think that the other party is trying to get money from you in any way possible, how bad was the damage? |
